HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fl.us File Number: 06-00780 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A JOINT PARTICIPATION AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH MIAMI DADE COLLEGE ("MDC"), TO IMPLEMENT CONSTRUCTION PLANS FOR IMPROVEMENTS TO THE MDC WOLFSON CAMPUS PROMENADE, LOCATED AT NORTHEAST 4TH STREET BETWEEN BISCAYNE BOULEVARD AND NORTHEAST 2ND AVENUE, MIAMI, FLORIDA, IN THE AMOUNT OF $185,000; ALLOCATING SAID FUNDS FROM THE TRANSIT HALF -CENT SURTAX PROGRAM, THE SCHEDULED 2006 FLORIDA DEPARTMENT OF TRANSPORTATION REIMBURSEMENT, AND MDC'S CONTRIBUTION OF FUNDS. WHEREAS, Miami Dade College ("MDC") wishes to make improvements to the Miami -Dade Wolfson Campus Promenade which runs along Northeast 4th Street between Northeast 2nd Avenue and Biscayne Boulevard, Miami, Florida ("Project"); and WHEREAS, MDC has been granted funds by the Florida Department of Transportation ("FDOT") in the amount of $875,000, for the design and construction of improvements to the Project, to be allocated in 2006; and WHEREAS, at the request of MDC, the City of Miami ("City") has agreed to implement construction, manage, supervise and inspect all aspects of the Project construction until its completion, and the City shall match MDC's financial contribution to the Project, in accordance with Section 339.12, Florida Statutes; and WHEREAS, the aforementioned funds from FDOT shall be redirected to the City to reimburse for eligible expenses incurred due to implementation of the Project in 2006, subject to the FDOT's terms and schedule; and WHEREAS, the attached Joint Participation Agreement ("JPA") was negotiated with MDC detailing the responsibilities of the City and MDC for the administration of the Project as outlined herein; and WHEREAS, funds for this purpose are available from the Transit Half -Cent Surtax in the amount of $185,000, the scheduled 2006 FDOT reimbursement, and funds contributed by MDC; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized(1) to execute a JPA, in substantially the attached form, City of Miami Page 1 of 2 Printed On: 5/4/2006 File Number: 08-00780 with MDC, to implement construction improvements to the Project, in the amount not to exceed $185,000, with funds allocated from the Transit Half -Cent Surtax, the scheduled 2006 FDOT reimbursement, and MDC's contribution of funds. FER ANDEZ CITY All ORN = Y Footnotes: {1) The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
