Subject: Resolution to approve an emergency finding pursuant to City Code Section 18-90 and to award
a contract to CMC Construction, Inc. for renovation to the Dinner Key Spoil Islands and the City's
Miami Watersports Complex facilities utilized by Shake -A -Leg Miami.
Purpose of Item:
To request approval of the attached resolution, by a four -fifths affirmative vote adopting the City
Manager's finding of an emergency, waiving competitive bidding procedures and to authorize the City
Manager to execute a contract with CMC Construction, Inc. (CMC) in an amount not to exceed
$1,407,000.
Background Information:
The City of Miami (City) and the Shake -A -Leg Miami have been working on renovations to the City's
Miami Watersports Complex property at 2620 South Bayshore Drive where the Shake -A -Leg Miami
operates their program. Shake -A -Leg has continued to grow at a fast rate and renovation and upgrades
are needed to meet the demands of their program. These include a renovation of the historic Coast
Guard hanger, an additional elevator and electrical upgrades to the administration building,
installation of an emergency generator, and exterior site improvements. In addition, clean-up and
enhancement to the Dinner Key Spoil Islands in the immediate. vicinity will occur, which will include
the installation of a floating dock. The City has obtained two grants towards the completion of these
projects. A FIND grant, requiring a 50% match was obtained for the Spoil Islands and a Safe
Neighborhood Parks Bond Program (SNPB) grant was obtained for use towards the remainder of the
needs. The SNPB grant funds must be spent by August 2006. Even with the grant funds combined
with the construction funds available from the City there is still a significant shortfall of available
funding. CMC has offered to donate their time and costs, obtain reduced or free materials and have
other contractors donate or discount their costs to perform the work within the available funds, while
at the same time prioritizing the work so that the grant funds are not lost.
