HomeMy WebLinkAboutR-06-0264City of Miami Legislation Resolution: R-06-0264 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-00649 Final Action Date: 5/11/2006 A RESOLUTION OF THE MIAMI CITY COMMISSION TERMINATING THE CONTRACT WITH MARTIN'S LAMAR UNIFORMS, FOR THE PROVISION OF UNIFORMS AND ACCESSORIES (GROUP 1), FOR THE DEPARTMENT OF POLICE, PURSUANT TO RESOLUTION NO. 04-335, ADOPTED MAY 27, 2004, AMENDED BY RESOLUTION NO. 05-188, ADOPTED MARCH 24, 2005, FURTHER AMENDED BY RESOLUTION NO. 05-562, ADOPTED SEPTEMBER 22, 2005; AWARDING THE BID IN ITS ENTIRETY TO HARRISON UNIFORMS, UNDER THE SAME PRICES, TERMS AND CONDITIONS PURSUANT TO BID NO. 03-04-009. WHEREAS, pursuant to Resolution No. 04-0335, adopted May 27, 2004, the bids of Martin's Lamar Uniforms, for Group 1 Alternate Bid, and Harrison Uniforms, from Groups 2 through 9, for the provision of uniforms and accessories, for the Department of Police, for a one-year period with the option to renew for two (2) additional one-year periods, at a first year annual amount not to exceed $950,000, subject to an increase of 4% for Martin's Lamar Uniform ("Martin's") for each year thereafter, and an increase of 6% for Harrison Uniforms for each year thereafter, with funds allocated from the Department of Police General Operating Budget, Account Code No. 001000.290201.6.075; and WHEREAS, pursuant to Resolution No. 05-0188, adopted March 24, 2005, the City Commission included the use of grants as an additional funding source for future fiscal years, subject to budgetary approval; and WHEREAS, pursuant to Resolution No. 05-0562, adopted September 22, 2005, the City Commission changed Martin's Lamar Uniforms Group 1 Alternate Bid to Group 1 Base Bid; and WHEREAS, pursuant to Sections 1.24 and 2.27 of the contract, Martin's has been found in default for non-performance; and WHEREAS, despite several meetings between Martin's, the Department of Police and the Department of Purchasing, Martin's has failed to remedy the default; and WHEREAS, due to Martin's inability to remedy the default, termination of its contract has been recommended by the Department of Purchasing; and WHEREAS, the Department of Police has evaluated the uniform clothing provided by the next low bidder, Harrison Uniforms, and has found the uniform clothing to meet the specifications of the bid; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The contract with Martin's, for the provision of uniforms and accessories (Group 1), for the Department of Police, pursuant to Resolution No. 04-335, adopted May 27, 2004, amended by Resolution No. 05-188, adopted March 24, 2005, further amended by Resolution No. 05-562, adopted September 22, 2005, is terminated, and the bid is awarded in its entirety to Harrison Uniforms, under the same prices, terms and conditions pursuant to bid no. 03-04-009. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
