A resolution, declaring surplus and approving the sale of the city -owned property located at 123 S.W. North.
River Drive, Miami, Florida, as more particularly described in Exhibit "A" attached hereto and made a part
hereof, to 121 River Drive Associates, LLC., a Florida Limited Liability Corporation, establishing Three
Hundred Thousand Dollars ($300,000.00) as the amount to be paid to the City of Miami by the aforementioned.
Further authorizing the City Manager to execute an Agreement for Purchase and Sale, in substantially the form
attached, and to execute such other documents as may be necessary to consummate such transaction in.
accordance with the terms and conditions of the agreement, which terms may be amended by the City Manager
as may be necessary in order to meet the best interests of the City.
Background Information:
The City of Miami has been approached by 121 River Drive Associates, LLC., a Florida Limited Liability
Corporation, regarding the sale of 3,750 sq. ft. City -owned property located at 123 S.W. North River Drive,
Miami, Florida. There is a road located across the Property that is a paved driveway with no official street or
alley platted or recorded across this Property. Currently the Property sits vacant, represents a maintenance cost
and liability to the City, and does not generate ad valorem taxes. A purchase price of Three Hundred Thousand
Dollars ($300,000.00) or approximately $80.00 per sq. ft, is to be paid by the Purchaser to the City. Section
29-B of the Charter of the City of Miami creates an exception from City requirements for competitive bidding
for disposition of non -waterfront City -owned property to an adjacent property owner when the subject property
is 7,500 square feet or less, or the subject non -waterfront property is non -buildable. The area contained in the'
Property is not in excess of 7,500 square feet, is non -buildable, is non -waterfront, and its conveyance to the
adjacent property owner would assist in providing for the assemblage of land by the Purchaser. The property
will be conveyed "as is" and "where is" and the City will not warrant the sufficiency of its title nor any interest
it may have in the property.
