A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN EMERGENCY RELIEF
PROGRAM AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH
THE STATE OF FLORIDA, DEPARTMENT OF TRANSPORTATION ("FOOT"), TO
UNDERTAKE AND COMPLETE CERTAIN EMERGENCY RELIEF EFFORTS FROM
THE DAMAGE INFLICTED BY HURRICANES KATRINA AND WILMA DURING THE
HURRICANE SEASON OF 2005, ASSOCIATED WITH FEDERAL AID HIGHWAYS
OR ROADS ON FEDERAL LANDS WITHIN ITS JURISDICTION AS DEFINED BY
SAID PROGRAM; FURTHER AUTHORIZING THE CITY MANAGER TO SUBMIT
RELATED CLAIMS TO FOOT AS DESCRIBED IN THE DETAIL DAMAGE
INSPECTION REPORTS, AS DESCRIBED IN "EXHIBIT A," ATTACHED AND
INCORPORATED, AND TO ACCEPT PAYMENTS FOR SAME.
WHEREAS, during the hurricane season of 2005, Hurricanes Katrina and Wilma produced
disastrous conditions which had a devastating impact upon South Florida; and
WHEREAS, pursuant to Title 23, United States Code, §125, an Emergency Relief Program was
made available to the City of Miami ("City") as a result of Hurricanes Katrina and Wilma; and
WHEREAS, said Emergency Relief Program Agreement ("Agreement") allows the State of Florida,
Department of Transportation ("FDOT") to act as the administrator on behalf of the Federal Highway
Administration for the reimbursement of Emergency Relief Program funding for damaged inflicted by
said storms associated with Federal aid highways or roads on federal lands within its jurisdiction as
defined by said program; and
WHEREAS, the City Manager recommends the adoption of this Resolution which will enable the
City to accept funds from FDOT, through the State of Florida, as reimbursement for eligible costs
incurred by the City for disaster relief activities described in the Detailed Damage Inspection Reports
("DDIR"), as described in "Exhibit A," attached and incorporated;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2, The City Manager is authorized{1 } to cxocute ari Agreement, in substantially the
attached form, with FOOT, to undertake and complete certain emergency relief efforts from the
damage inflicted by Hurricanes Katrina and Wilma during the 2005 hurricane season, associated with
Federal aid highways or roads on federal lands within its jurisdiction as defined by said program.
Section 3. The City Manager is further authorized to submit related claims to fDOT as described in
ttie ODiR, as described in "Exhibit A," attached.and incorporated, and toacceptpayments for same.

Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
