This application is intended to serve as a guide in acquainting you with our public hearing process. By any means, please feel free to contact us at the number above, should you have any questions. CITY OF MIAMI ORDINANCE NO. 11469, CODIFIED IN CHAPTER 2, ARTICLE VI OF THE CITY CODE STATES THAT ANY PERSON WHO RECEIVES COMPENSATION, REMUNERATION OR EXPENSES FOR CONDUCTING LOBBYING ACTIVITIES TO REGISTER AS A LOBBYIST WITH THE CITY CLERK, PRIOR TO ENGAGING IN LOBBYING ACTIVITIES BEFORE CITY STAFF, BOARDS, COMMITTEES AND THE CITY COMMISSION. A COPY OF SAID ORDINANCE IS AVAILABLE IN THE OFFICE OF THE CITY CLERK (MIAMI CITY HALL), LOCATED AT 3500 PAN AMERICAN DRIVE, MIAMI, FLORIDA, 33133. Copies of lobbyist documentation with proof of payment must be submitted with the complete application. The responses to this application must be typed and must be signed in black ink. The deadline to file the complete application, along with pertinent documents, is the first five working days (1-5) of each month —unless extended because of a holiday —from 8:00 am until 3:00 pm. If you like, you could bring the materials to our office for staff review before the deadline to ensure the application is complete. Please note that the cashier on the 4th floor will close at 4:00 pm; therefore, a paid receipt must be submitted before the deadline. Upon submittal, this application must be accompanied with a signed Zoning Referral. You will be responsible, if needed, to bring an interpreter for the English language to any presentation before city boards, committees and the city commission. A valid power of attorney will be required if neither applicant or legal counsel representing the applicant execute the application or desire to make a presentation before city boards, committees and the city commission. An additional fee to record Zoning Board resolutions will be charged and it is determined contingent upon fees charged at the time of recordation. Go to the Miami -Dade County Recorder's Office at 22 NW First Street, First Floor, and ask for a certified copy. Please have the original recorded document mailed to the address above and bring the certified copy to our office. Copies of City Commission resolutions can be obtained at our website through the "Legislative Hub", or for certified copies, contact the City Clerk's Office at 305-250-5360. Applications given to customers do not constitute action from the City of Miami without plans review and written comments from Zoning. Rev. 11-23-05 Within the City generally, or within certain zoning districts, certain structures, uses, and/or occupancies specified, are of a nature requiring special and intensive review to determine whether or not they should be permitted in specific locations, and if so, the special limitations, conditions, and safeguards, which should be applied as reasonably necessary to promote the general purposes of the Zoning Ordinance and, in particular, to protect adjoining properties and the neighborhood from avoidable potentially adverse effects. It is further intended that the expertise and judgment of the Miami Zoning Board be exercised in making such determinations, in accordance with the rules, considerations and limitations relating to Special Exceptions (see Article 16 of the Zoning Ordinance). Formal public notice and hearing is mandatory for Special Exceptions. The Zoning Board shall be solely responsible for determinations on applications for Special Exceptions, except when otherwise provided for in the City Code. All applications shall be referred to the Director of the Planning Department for his/her recommendation(s) and the Director shall make any further referrals required by these regulations. The Survey was issued in support of another project, Lafayette Square, situated only a few blocks away and confirmed that the proposed parking would be sufficient for the affordable housing project. This Survey was performed using the existing Miami River Park apartments which is located in a similar neighborhood and is expected to have tenants with similar backgrounds. Due to the close proximity of this project to that of Lafayette Square, as well as both projects being geared towards the same market, the Survey would naturally produce the same results as those in the attached report, namely that the parking provided is sufficient to meet the needs of the affordable housing project. We have also obtained research on the census tract for this neighborhood, attached for your review, which shows that the rental residents in the area have an average of .8 cars per household while the proposed project is providing 1.2 cars per household. I am also forwarding copies to Teresita Fernandez so that she can include the Parking Occupancy survey with the other backup for this Special Exception application. The reason for this survey was to estimate the percent parking occupancy of that apartment complex and determine based on the results of the study, the parking demand for the LaFayette Square Phase II project. LaFayette Square (Phase II) is a proposed residential project of the same type within the City of Miami. INTRODUCTION LaFayette Square is a proposed affordable housing residential project located on NE 79th Street mid -block between NE 2" d and NE lst Avenues in Miami, Florida. The project consists of approximately 310 residential dwelling units. The project will be built in two phases. Phase II consists of 146 housing units for low income families and individuals. Primary access to the site is proposed on NE 79th Street via a two-way driveway. The 14-story tower at Miami River Park is an affordable housing residential project consisting of 183 apartment units with a 331 parking space garage. The site is located at 445 NE 4 Street in Miami, Florida. 1 CORAL GABLES • FORT MYERS • FORT LAUDERDALE dpa DATA COLLECTION The rental application form from each tenant was reviewed by the Miami River Park management to obtain vehicle ownership information. A summary of this data was provided and is shown as Exhibit 1. PARKING OCCUPANCY Based on the compilation of the vehicle information data described above, there are 138 registered vehicles. By dividing the number of vehicles registered by the number of apartment units rented (138/177), the parking generation rate for Miami River Park was calculated at 0.78 parking spaces per unit. This rate will account for visitors and employees parking demand because they occur outside the peak period of parking occupancy (6:00 am) TRANSIT SERVICES Transit services in the vicinity of the project area were researched to determine the availability of transit for future residents of LaFayette Square. Miami -Dade Transit (MDT) has currently a bus route (Route L) operating along NW 79th Street in front of the proposed development. This bus route operates 24 hours, seven days per week. Bus routes 9 and 10 operate along NE 2nd Avenue in the immediate vicinity of the project. These routes operate from 5:00 am to 11:00 pm, seven days per week. In addition, bus routes 3, 16, and Biscayne MAX operate along Biscayne Boulevard and route 2 along Miami Avenue. These routes are within a short walking distance from the proposed project. CONCLUSION AND RECOMMENDATIONS The parking generation rate for the Miami River Park apaitments was calculated to be 0.78 parking spaces per apartment unit. Due to the similar use and occupancy (housing for low income families and individuals) the same parking generation rate should be used for Phase II of LaFayette Square. Using this generation rate, the estimated need for parking spaces for LaFayette Square Phase II will be 114 spaces (0.78 x 146). Under Section 917.6 of the Miami Zoning Ordinance, the number of parking spaces allowed by Special Exception is 140, substantially more than the calculated need based on actual experience at Miami River Park. However, to be more conservative, and to provide for unusual circumstances, it is recommended that the LaFayette Square Phase II project provides 161 parking spaces. This will provide one space for each apartment unit, plus 15 additional 2 dpo visitor's spaces. It is our opinion that this reduction in off-street parking requirements is appropriate in view of the nature and type of prospective occupancy, transit availability in the area, and the economic circumstances involved. Additionally, such reduction will not unduly burden traffic or parking facilities in the neighborhood. If you have any questions or require additional information, please contact me.
