Guinn Governor Greg Smith Administrator The following shall be a part of Bid No. 7066 for A Multi -state Contract for Industrial Supplies & Equipment, Lighting Products, Janitorial Supplies & Equipment. Section I: Please note that the correct time and date for bid opening: September 14, 2005 @ 3:00PM Section II: Section 3.17 of the bid document shall be removed and the following substituted. Contract prices represents ceiling prices for the supplies and services priced in the award(s). The vendor shall report to the Lead State any price reduction or discount, or other more favorable terms, offered to any Purchasing Entity, and the awarded vendor agrees to negotiate in good faith to reestablish ceiling prices or other more favorable terms and conditions applicable to future orders. Vendors that engage in innovative procurement practices such as strategic sourcing, aggregate purchasing, etc., with a Purchasing Entity at the request of the Purchasing Entity are exempt from the reporting requirement. Section III: The following States have indicated their intent to participate, via written letter, in awards issued from this solicitation. This list is not all-inclusive; Other States may indicate their written intention to participate at a later date. Alaska Colorado Louisiana Montana Nevada Oregon Oklahoma Utah Section IV: The following answers are to all questions submitted in writing: 1. Please advise if vendors must return all pricing forms even if bidding on just a few items. Yes. The entire bid must be returned. 2. For line items 2.30, 2.31 and 2.32 for can Iiners, the bid specifies "packages" — Is this equivalent to cases? Not necessarily. Please list the quantity per package and the amount of packages per case. It is far better to supply more information than less information when responding to this bid 3. Please provide that approx. number of delivery locations. This bid is intended for use by multiple States and their individual Counties, Cities, School Districts etc within each State. Therefore, it is impossible to list the number of delivery locations. 4. Please provide the name of the previously awarded vendor for line items 2.30-2.32 and their price per case. The current awarded vendor is Grainger, Inc. Grainger pricing for items 2.30-2.32 are as follows: 2.30 = 494 per roll of 50, sold per roll 2.31= 4.01 per roll of 25, sold per roll 2.32= 5.91 per roll of 20, sold per roll 5. Does a vendor need to bid on all items in an entire section of the bid or may we bid on only a few? The overview section of bid 7066, page 3 states "Bids will be accepted from qualified vendors that can provide one (I) or all products at the minimum of one of the thirteen categories listed.." 6. We would appreciate you supplying us with the award pricing and winning vendor from the last bid for the liners. Please see response # 4. 7. Attachment E has specified manufacturers listed. Would it be appropriate to submit a price for that manufacturer and as well as another column with a different manufacturer at a lower price? Yes, as long as you also supply evidence that the other manufacturer's product meets or exceeds the requirements as specified. 8. Would it be more responsive to our bid submittal to submit a lower price or should we bid only the specified manufacturer? The bid allows for products that meet or exceeds the requirements as specified. 9. The project overview notes that you reserve the right to competitively solicit additional sources. Does this mean that after receiving all the bids and awarding you won't purchase from the awardee but will seek bids for items during the two-year period? Where deemed to be in the best interest of the State or States, additional bids may be sought during the initial contract period. 10. Point 3.14 says that the estimates are not guarantees, what do you base your estimates on? Are the estimates annual of 2-year estimates? The estimates are based on previous history for the period of January — December 2004. 11. When requesting vendors to guarantee pricing for 2-years, how do vendor protect themselves from inflation? The cost of steel has risen over 100% in the past 2-years and many other items have increased higher that the CPI. Companies cannot be expected to sell their products at a loss, so how do you handle a situation like that? The vendors are expected to project pricing over the next 2-years. However, it is never the intention of the WSCA to expect the vendors to function at a loss. Price increases from vendors are considered if the vendor presents evidence of a price increase via the CPI (Consumer Price Index) or other recognizes forecasting entity. 12. Regarding point 3.15, annual 1-year extensions, must both parties agree to this or may the vendor opt out if prices rose higher that we were allowed to charge? Both parties must agree on annual extensions. Vendors may opt out or request price increases during the negotiations of annual extensions. 13. Regarding point 4.1.1.2, we are located in Michigan and collect Michigan sales tax. We sell to various government entities all across the nation and do not charge sales tax to the State, counties or any company in the State of Nevada. Does this disqualify us or if we have a federal tax I.D. does that mean that we are licensed by the Nevada Dept of Taxation for this bid's purpose? Per Nevada Revised Statute §360. 780, the selected vendor, prior to doing business in the State of Nevada, must be appropriately licensed by the Department of Taxation, in accordance with NRS. Please contact the Nevada Dept. of Taxation to clarify your taxation status. 14. Is it possible to obtain pricing from the current vendor's contract? Yes. Please request in writing the items you are interested in. 15. Can you provide more specific information on "Condor" i.e., website, full company name or contact information if nothing else is available? The same for North, Wells, Lamont and Best. Yes. The full names of these companies are: Condor, North Safety, Wells -Lamont and Best Glove. The companies are all available for research via the Internet. 16. Will the State of Nevada on behalf of the Western States Contracting Alliance (WSCA) offer a best and final negotiations period after the supplier(s) have been selected in order to further negotiate more favorable WSCA terms and conditions and or additional products and services? Yes. 17. Section 3.7 of the bid stipulates 24-48 hour shipping on in -stock items. Please advise if this refers to regular business hours Monday thru Friday for orders placed before 5pm local time. In ordinary circumstances the 24-48 hours shipping time refers to Monday -Friday and orders placed before 5pm local time. There are however emergency circumstances where regular shipping times and agreements will have to be altered. 18. In section 3.7, please define what consideration will be provided in "Delivery time will be considered during the award of this contract." The speed of delivery of items is an important factor in this bid, i.e., can your company deliver to all proposed areas in 24 hrs.? 48hrs.? Does your delivery schedule vary from location to location? These are all factors that the evaluators will take into consideration when reviewing your bid response. 19. Does WSCA insist that the pricing offered by the awardee(s) under this contract for the market basket of items as well as the balance of the line be consistent across all WSCA Participating States regardless of transaction type, will call, phone and internet orders? This question is not intended to offer further discounts; it is an attempt to determine how important having consistent contract pricing on unique items across multiple states and multiple transaction types for contract patrons. Pricing should be consistent for all types of transactions and locations irregardless of State for all market basket and balance of the line items. 20. For filters beginning in section 4.18, can you tell me if these filters are in a box frame or pinched? Box frame. 21.Considering the number of product categories on this bid, are suppliers who bid more than one category looked upon more favorably than those who may be only able to bid one category? This bid may be awarded as a multiple bid; therefore, it not viewed as more or less favorable to bid on more than one category. 22. Is the administrative fee (0.1%) paid to each Participating state or just to the State of Nevada? The administrative fee is collected by the State of Nevada for and in behalf of the Western States Contracting Alliance (WSCA). 23. There is no mention by the Participating States of an additional administrative fee (not to exceed 1%). Does that mean that those states do not impose such an additional fee? Some Participating States require an additional administrative fee capped at 1%. This requirement will be listed in that State's Participating Addendum Terms and Conditions. If there is no mention of an additional fee, as is the case with the State of Nevada, it is not required. 24. If a Participating State does require and additional administrative fee, how is it identified to the bidders? This requirement will be listed in that Participating State's Terms and Conditions. 25. With the price of fuel continuing to rise and it's integral effect on distribution and delivery costs, are you firm of the requirement for FOB Destination for all items anywhere? Yes. This requirement is firm. 26. What is your definition of on-line workflow management and workflow management controls? While it is this solicitation's intention that the vendor describe what their on-line system can provide, WSCA is most interested in how your on-line system allows for approval controls of order requests that are placed by field personnel and; how your system routes these order requests to supervisors and budgetary approval personnel. This workflow allows for final approval by supervisors and or budgetary personnel before the actual order is confirmed/approved and submitted/committed to the vendor's order database. 27. Attachment E addresses a quantity for each item. We realize that there is no implication or guarantee Ievel of purchases; however, previous orders are a possible indicator. Is the quantity shown the actual quantity ordered during the previous contract period by the known Participating States or does that number include purchases from other states? This number is the actual quantity ordered during January — December 2004 as provided by the current vendor for all States currently participating in the award. 28. Attachment B, reports. Quarterly reports are required to show quantities and dollar volume purchases "by each agency". Does "each agency" mean State? Yes, reports are required to show quantities and dollar volume purchases per State. 29. Attachment B, Delivery. " The minimum shipment amount will be found in the special terms and conditions. There is no discussion of minimum shipment amount. May bidders specify a minimum quantity for FOB Destination? Yes. 30. What was the duration of the previous contract period? The previous contract was for 2 years with 2 one-year extensions. 31. Alaska Conditions 6, Extension of Prices: The first sentence runs into the margin and cannot be read. Please restate the paragraph. EXTENSION OF PRICES; In case of error in the extension of prices in the bid, the unit prices will govern; in a lot bid, the lot prices will govern. 32. Are items 12.23-25, 12.29, 12.35, 12.38, 12.39 and 12.43 it says PK100 is that the same as 100 per box? Yes, these are sold 100 per box/package. 33. Is the current contract listed in your website? If not, may I acquire a copy of the last contract with pricing included? Yes, information regarding the current contract is listed on the State of Nevada website.
