Pursuant to Article 4, Section 401 of Ordinance 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, the subject proposal has been reviewed for an
amendment to the Zoning Atlas as follows:
The request is to change the Zoning designation as follows:
The subject property of the entire block bounded by Bird Road, SW 37th Court, SW
38th Avenue and Peacock Avenue, with address at 3760 Bird Road (Complete legal
description on file at the Hearing Boards Office), from C-2 "Liberal Commercial" to
C-1 "Restricted Commercial".
The following findings have been made:
• It is found that immediately adjacent to the east and west and to the north across Bird
Road, the area is designated C-2 "Liberal Commercial"; to the south, the area is
designated 0 Office and to the southwest, the designation is I Industrial.
• It is found that this change of order to develop a mixed use development named Bird
Road Project as a Major Use Special Permit (MUSP).
• It is found that the requested change for the subject properties will create an isolated
area with a C-1 "Restricted Commercial" classification which in effect appears to be a
"spot zoning" in the area.
• It is found that the C-2 "Liberal Commercial" designation is the appropriate
classification for the proposed site and should remain; it already allows for the
proposed uses.
Based on these findings, the Planning Department is recommending denial of the
application as presented.
