HomeMy WebLinkAboutFR/SR LegislationCity of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fi.us File Number: 06-00107 Fina1 Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 54/ARTICLE V/SECTION 54-190 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/BASE BUILDING LINES/NONSTANDARD STREET WIDTHS," BY MODIFYING THE WIDTH OF NORTHEAST 11TH STREET BETWEEN NORTHEAST 1ST AVENUE AND NORTHEAST 2ND AVENUE, MIAMI, FLORIDA; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Article V of the Code of the City of Miami, Florida, as amended ("City Code") establishes base building line locations for all public streets within the City of Miami ("City"); and WHEREAS, Northeast llth Street between Northeast 1st Avenue and Northeast 2nd Avenue, Miami, Florida, was originally dedicated as 50 foot wide roadway; and WHEREAS, the zoned street width of this roadway was increased to 75 feet wide but has not been dedicated or developed to the 75 foot width; and WHEREAS, the City's Administration review of these transportation corridors reveals that the current 50 foot wide developed roadway adequately serves the present and future transportation needs of the public; and WHEREAS, to accommodate the pedestrian and traffic impacts, utility and access needs -compatible-with new deve meat -now being - -9d. in th-i . area, a reduction -in the -zoned -street -widths of Northeast llth Street between Northeast lst Avenue and Northeast 2nd Avenue, Miami, Florida, from 75 feet to 50 feet is warranted; and WHEREAS, the Departments of Police, Fire -Rescue and Solid Waste have evaluated the effect of the reduction of the zoned street width of these roadways on their operations and have no substantial objections; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORI DA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 54/Article V/Section 54-190 of the City Code, entitled "Streets and Sidewalks/Base Building Lines/Nonstandard Street Widths," is amended in the following particulars: {1} City of Miami Page 1 of 3 Printed On: 1/19/2006 File Number: 06-00107 "CHAPTER 54 STREETS AND SIDEWALKS ARTICLE V. BASE BUILDING LINES * Sec. 54-190. Nonstandard street widths. Section 4. If any Section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance shall become effective 30 days after final reading and adoption thereof.{2} APPROVED AS TO FORM AND CORRECTNESS JORGE .
