BEFORE ME, the undersigned authority personally appeared Roberto Brizuela
("Affiant"), who being first duly sworn on oath, deposes and says as follows:
1. The Affiant is a Professional Land Surveyor and Mapper of the State of Florida
under P.L.S. No, 3064, with the firm of Roberto Brizuela & Associates and has prepared that
certain Tentative Plat titled "INCANTO SUBDIVISION" under Job Number 07-02-151 dated
07-28-08 and Final Plat dated not recorded yet ("Plat") which describes certain real property
located in Miami -Dade County, Florida, as more particularly described in Exhibit "A", attached
hereto and made a part hereof ("Property").
2. The Property described in Exhibit "A" was the subject of a street closure and
vacation application with the City of Miami which was approved by the City Commission of the
City of Miami on March 23, 2006 by Resolution No, 06-0194.
3. That legal description attached to the application and approval for the street
vacation and closure prepared by Roberto Brizuela on June 16, 2008 by Job No. 08-02-69A
contained a scrivener's error in the call points of the legal description (attached as Exhibit " B"
hereto).
4. That the correct legal description (attached as Exhibit "C" hereto) provides the
correct and accurate legal description for the vacation and closure of street in regards to the
INCANTO SUBDIVISION plat.
5. The Affiant makes this affidavit for the benefit of Greenberg Traurig, P,A., the
City of Miami and Miami -Dade County, Florida in connection with the application for street
vacation and closure with respect to the Property described in Exhibit "A."
