A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BYA
FOUR -FIFTHS (4/STHS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC
HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S
RECOMMENDATION AND FINDING THAT COMPETITIVE NEGOTIATION
METHODS ARE NOT PRACTICABLE OR ADVANTAGEOUS PURSUANT TO
SECTION 18-86(A)(3)(C) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED; WAIVING THE REQUIREMENTS FOR SAID PROCEDURES;
APPROVING THE RECOMMENDATION AND FINDING OF THE CITY OF MIAMI'S
("CITY'S") DEPARTMENT OF PARKS AND RECREATION, THAT CITIZENS FOR A
BETTER SOUTH FLORIDA ("CFABSF"), A FLORIDA NOT -FOR -PROFIT
CORPORATION, IS THE MOST QUALIFIED FIRM TO PROVIDE ENVIRONMENTAL
EDUCATION, COASTAL CLEAN-UP, NATIVE REFORESTATION, AND PLANT
SPECIES OVERSIGHT SERVICES AT VIRGINIA KEY PARK; AUTHORIZING THE
CITY MANAGER TO EXECUTE A GRANT AGREEMENT WITH CFABSF, FOR A
PERIOD COMMENCING FEBRUARY 1, 2006 THROUGH SEPTEMBER 30, 2006, IN
AN AMOUNT NOT TO EXCEED $21,380; ALLOCATING FUNDS FROM ACCOUNT
CODE NO. 110161.580286, THE SPECIAL REVENUE FUND ENTITLED "VIRGINIA
KEY COMMUNITY STEWARDSHIP COASTAL ZONE MANAGEMENT PROGRAM,"
THAT CONSISTS OF THE COMMUNITY STEWARDSHIP AT VIRGINIA KEY
MATCHING GRANT FROM THE STATE DEPARTMENT OF ENVIRONMENTAL
PROTECTION, NO. CZ610, PURSUANT TO THE NATIONAL OCEANIC AND
ATMOSPHERIC ADMINISTRATION COOPERATIVE AWARD AND CITY MATCHING
FUNDS.
WHEREAS, the City of Miami's ("City's") Department of Parks and Recreation applied for a State
of Florida Coastal Zone Management Program Grant pursuant to the federal National Oceanic and
Atmospheric Administration Cooperative Award Program ("DEP/NOAA Program") to assist in the
environmental clean-up, native reforestation, and exotic plant species oversight at Virginia Key; and
WHEREAS, the application to the State indicated that the City would partner with Citizens for a
Better South Florida ("CFABSF") to provide the manpower, environmental education, and other
community stewardship services for the implementation of said grant for City parks areas on Virginia
Key; and
WHEREAS, the DEP/NOAA Program awarded the Community Stewardship at Virginia Key Grant
in the amount of $37,440 to the City; and
WHEREAS, said grant and the City's matching funds were appropriated into a Special Revenue
Fund pursuant to Resolution No. 05-0601, adopted November 3, 2005; and
WHEREAS, a grant agreement with CFABSF is required to set forth the terms and conditions of a
subgrant, to reimburse for services to be provided, and for compliance with the DEP/NOAA Program;

WHEREAS, the City Manager has approved the recommendation of the Department of Parks and
Recreation, has made a finding that pursuant to Section 18-86(a)(3)(c) of the Code of the City of
Miami, Florida, as amended ("City Code"), competitive negotiation methods are not practicable or
advantageous for obtaining said services, and has recommended to the City Commission that the
recommendations and findings be adopted;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City
Manager's recommendation and finding that competitive negotiation methods are not practicable or
advantageous pursuant to Section 18-86(a)(3)(c) of the City Code, waiving the requirements for said
procedures, is ratified, approved and confirmed, and the recommendation and finding of the City's
Department of Parks and Recreation, that CFABSF, a Florida not -for -profit corporation, is the most
qualified firm to provide environmental education, coastal clean-up, native reforestation, and plant
species oversight services at Virginia Key Park, is approved.
Section 3. The City Manager is authorized{1} to execute a grant agreement with CFABSF, for a
period commencing February 1, 2006 through September 30, 2006, in an amount not to exceed
$21,380, with funds allocated from Account Code No. 110161.580286, the Special Revenue fund
entitled "Virginia Key Community Stewardship Coastal Zone Management Program," that consists of
the Community Stewardship at Virginia Key matching grant from the DEP/NOAA Program, and City
matching funds.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
(1) If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
{2} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
