Insofar as it is practicable, as determined by the chief procurement officer, for small pur- chases of by to $10,000,00, at least three quotations shall be sought except as oth- erwise provided in this article. Award shall be made on the basis of competitive bidding. The names of offerors submitting written, electronic or facsimile quotations and the date and amount of each quota- tion, shall be recorded and maintained as a public record. (3) Small purchases up to $5,000.00. The chief procurement officer shall adopt op- erational procedures for making small purchases up to $5,000.00. Such proce- dures shall provide for obtaining ade- quate and reasonable competition for the goods and services being purchased inso- far as it is practicable and shall require the maintenance of adequate written records to document the purchasing deci- sion. Such records .shall be open to public inspection. (d) Award. (1) Goods, supplies, equipment and contrac- tual services. Small purchases up to $25,000.00 shall be approved by the chief procurement officer on the basis of com- petitive bidding methods.. However, if the amount of the quotation submitted by an. offeror with a local office is not more than. ten percent in excess of the lowest other responsive and responsible offeror, such offeror may be offered the opportunity of accepting the contract at the lowest infor- mal bid amount. The chief procurement officer shall have the authority to reject any or all informal bids. (2) Professional and personal services. Except for the performance of legal services, when- ever the total cost for a contract for pro- fessional or personal services is $25,000.00 or lees, one written proposal shall be sought and the award shall be made by the chief procurement officer on the basis of competitive negotiations. (a) Any public work or improvement may be executed either by contract or by the city labor force, as may be determined by the city commis- sion. There shall be a separate accounting as to each work or improvement. Before authorizing the execution by the city labor force of any work or improvement or phase thereof, the city manager shall submit to the city commission a description of the anticipated scope of work and related cost estimates. (b) All contracts for public works or improve- ments in excess of $215,000.00 shall be awarded to the lowest responsive and responsible bidder af- ter public notice on the basis of competitive sealed bidding methods, as provided herein or as pro- vided in applicable Florida Statutes, whichever is determined to be in the best interest of' the city; provided, however that if, on the basis of the competitive sealed bidding methods, the amount of the bid submitted by a bidder with a local office is not more than ten percent in excess of the lowest other responsive and responsible bidder, such local bidder may be offered the opportunity of accepting the contract at the low bid amount. Notwithstanding the foregoing, the city man- ager may waive competitive sealed procurement methods by making a written finding, supported by reasons, that a valid emergency exists or that there is only one reasonable source of supply, which finding must be ratified by an affirmative vote of four -fifths of the city commission after a properly advertised public hearing. When compet- itive sealed procurement methods are waived, other procurement methods as may be prescribed by ordinance shall be followed, except for the cone of silence provisions; (c) Public notice shall be in accordance with the applicable Florida Statutes.
