HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci,miami,Fl.us File Number: 06-00257 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO SUBMIT AN APPLICATION FOR GRANT FUNDING TO THE FLORIDA INLAND NAVIGATION DISTRICT ("FIND") WATERWAYS ASSISTANCE PROGRAM, IN AN AMOUNT NOT TO EXCEED $1,000,000, FOR THE PHASE IIIA-CONNECTOR OF THE BICENTENNIAL PARK SHORELINE STABILIZATION PROJECT ("PROJECT"); AUTHORIZING THE ALLOCATION OF REQUIRED MATCHING -FUNDS FOR FIFTY PERCENT (50%) OF PROJECT COSTS, IN AN AMOUNT NOT TO EXCEED $1,000,000, FROM THE PROCEEDS OF THE SECOND SERIES HOMELAND DEFENSE/NEIGHBORHOOD IMPROVEMENT BONDS PREVIOUSLY APPROVED BY VOTER REFERENDUM FOR CAPITAL IMPROVEMENTS PROJECT NO. 331418, ENTITLED "BICENTENNIAL PARK IMPROVEMENTS;" AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SUBMISSION OF THE FIND GRANT APPLICATION FOR FISCAL YEAR 2006-2007, SUBJECT TO THE TERMS AND CONDITIONS OF SAID GRANT APPLICATION. WHEREAS, the City of Miami ("City") wishes to continue stabilization of the shoreline at Bicentennial Park by implementing the Phase Ilia -Connector; and WHEREAS, the Phase Ilia -Connector of the Bicentennial Shoreline Stabilization Project is necessary in order to finish restoration of the seawall at Bicentennial Park along the Intracoastal Waterway; and WHEREAS, the Phase Illa-Connector ("Project") "connects" Phase II and Phase III of the Bicentennial Shoreline Stabilization Project of which the City has received grant monies from the Florida Inland Navigation District ("FIND") in the amounts of $419,670 and $1,000,000 respectively; and WHEREAS, the Project will benefit the citizenry of the City and the State of Florida by providing a public plaza and continuation of a pedestrian promenade; and WHEREAS, the total cost of the Project is estimated not to exceed $2,000,000; and WHEREAS, the City is allocating the matching funds of $1,000,000 in the manner provided herein for this Project; and WHEREAS, the City wishes to apply for grant funding from FIND for the Project in an amount not to exceed fifty percent (50%) of the total project cost, or not more than $1,000,000, to be matched by an equal amount of City funds; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 3 Printed On: 2/22/2006 File Number: 06-00257 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1) to submit an application for grant funding to Find Waterways Assistance Program, in substantially the attached form, in an amount not to exceed $1,000,000, for the Project, and to execute the necessary documents required by FIND, including the Program Agreement, all as are attached hereto, to implement this Resolution. Section 3. The City Attorney is authorized to execute "Attachment E-7," the Attorney's Certification of Title. Section 4. The City of Miami further certifies to FIND the following matters: (1) The City accepts the terms and conditions set forth in FIND Rule 66B-2 F.A.C., which outlines the Waterways Assistance Program and which will be a part of the project Agreement for any assistance awarded under the proposal; (2) The City is in complete accord with the proposal and agrees to carry out the program in the manner described in the proposal and any plan and specifications attached thereto, unless prior approval for any change has been received from FIND; (3) The City has the ability and intention to finance its share of the cost of the Project and that the Project will be operated and maintained at the expense of the City for public use; (4) The City will not unlawfully discriminate against any person on basis of race, color or national origin in the use of any property or facility acquired or developed pursuant to this proposal, and shall comply with the terms and intent of the Title VI of the Civil Rights Act of 1964, P.L. 88-352 (1964) and design and construct all facilities to comply fully with statues relating to accessibility by handicapped persons as well as other federal, state and local laws, rules and requirements; (5) The City agrees to maintain adequate financial records for the proposed Project to substantiate claims for reimbursement; and (6) The City will make available to FIND, if requested, a post -audit of expenses incurred on the Project prior to, or in conjunction with, request for the final ten percent (10%) of the funding agreed to by FIND. Section 5. The allocation of required matching funds, in an amount not to exceed $1,000,000, from the proceeds of the second series Homeland Defense/Neighborhood Improvement Bonds previously approved by voter referendum for Capital Improvements Project No. 331418 entitled "Bicentennial Park Improvements," is authorized. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS%' City of Miami Page 2 of 3 Printed On: 2/22/2006 File Number: 06-00257 Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
