A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A PROJECT CO-OPERATION
AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH BALLET
GAMONET, PURSUANT TO RESOLUTION NO. 03-911, ADOPTED SEPTEMBER
5, 2003; AMENDING RESOLUTION NO. 03-911, BY CHANGING THE LOCATION
OF THE PROJECT, RESTRICTING THE USE OF THE GRANT MONEY TO
CAPITAL IMPROVEMENTS AND CORRECTING AN ERROR IN THE LISTING OF
THE PROJECT FUNDING SOURCE.
WHEREAS, pursuant to Resolution No. 03-911, adopted September 5, 2003, the City Commission
approved the execution of an Agreement ("Agreement") with Ballet Gamonet ("Gamonet") for the
purchase of certain dance performance/rehearsal and related equipment ("Equipment"), related capital
improvements which would be owned by the City of Miami ("City") and leased to Gamonet at a nominal
amount, and funding of certain capital improvements; and
WHEREAS, in the interest of making the best use of the appropriated grant money, it has been
determined that the funds should be used strictly for capital improvements and not for the purchase of
the Equipment and that the capital improvements shall be the sole property of the City; and
WHEREAS, it was approved that the capital improvement project would take place at the Alfred I.
DuPont Building, located at 169 East Flagler Street in (Downtown) Miami, Florida, and Gamonet has
since relocated to 77 Northeast 24 Street, Miami, Florida, which is situated in the same District 2
(Downtown), area of the City ; and
WHEREAS, the source of funding was incorrectly referenced as Capital Improvement Project No.
341210 and it has been determined that this was a scriveners error; and
WHEREAS, the City and Gamonet have not signed a Project Co -Operation Agreement
("Agreement") concerning this matter;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings found in the Preamble of this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to execute an Agreement, in substantially the
attached form, with Gamonet, pursuant to Resolution No. 03-911, adopted September 5, 2003.
Section 3. Resolution No. 03-911, is amended to change the location of the project, to restrict the
use of the grant money to capital improvements and to correct an error in the listing of the project
funding source, in the following particulars:{2}

Section 2. The City Manager is authorized {1} to execute an Agreement, in substantially the
attached form, between the City and Gamonet for a public ballet project, located at in tho
Alfrod I. Dupont Building at 169 East Flagler Street, 77 Northeast 24 Street, Miami, Florida,
to provide City funding, in the amount of $300,000, for
capital improvements, to be owned by the City, aid -leased -to-
for publicly accessible and certain free or reduced costs
ballet performances, subject to the terms of the herein Resolution and the Agreement, with
funds allocated from District 2 {Downtown) Quality of Life Capital Improvement Project No.
3419-311712, Improvements Project under the Homeland Defense -Neighborhood
Improvement Bond Program.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor. {2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
