N/A. Consideration of an Ordinance of the Miami City Commission amending Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, by amending Article 12, Section 1201, Duties of City Commission, in order to clarify that City Commission review of Zoning Board decisions is by hearing de novo; further amending Article 20, Status of Decisions of Zoning Board; Review by City Commission; Commission powers, etc. to provide guidelines for a hearing de novo before the City Commission; containing a repealer provision and severability clause; and providing an effective date. Approval. Recently, a Circuit Court ruled that appeals from the Zoning Board to the City Commission are to be conducted like appellate hearings. However, the City's practice is to conduct these hearings de novo "new hearing" where all parties can address the City Commission with new evidence, etc. This amendment is simply to clarify that this is the City's practice. 2005-093 Item #3 Recommended approval to VOTE: 7-0 City Commission.
