Case No. 2005-1007
VACATION AND CLOSURE OF A PUBLIC RIGHT OF WAY, BEING AN
ALLEY LOCATEDNORTH OF NE 36th STREET BETWEEN NORTH MIAMI
AVENUE AND NE MIAMI COURT.
Pursuant to Section 55-15 (c) of the Miami City Code, the Planning and Zoning Department
has reviewed the proposed public right-of-ways vacation and closure to determine whether it
is in the public interest, or whether the general public would benefit from the vacation of the
right-o f-way.
The following findings have been made:
• It is found that this application was presented to the Plat and Street Committee and the
tentative Plat was approved unanimously with conditions. (See Public Work
Department's analysis).
• It is found that the vacation of the right of way is required to complete a mixed use
redevelopment project as part of a Major Use Special Perrnit (MUSP).
• It is found that upon compliance with condition set forth below, the proposed right of
way vacation will comply with Section 55--15 (c) of the Miami City Code for public
benefit .
Based on these findings, the Planning Department recommends approval of the
request subject to the following condition:
1. The applicant must comply with conditions from Public Work Department
(see attachment) and site pedestrian improvements contained in
Class II 05-0166 for the "ELECTRA" development (see attached Intended
Decision 2) which includes wide sidewalks, uniform pavers and public
accessibility to the plaza along NW 36th Street.
