HomeMy WebLinkAboutR-06-0121City of Miami Legislation Resolution: R-06-0121 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-00179 Final Action Date: 2/23/2006 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 2, IN SUBSTANTIALLY THE ATTACHED FORM, TO THE AGREEMENT WITH RECREATIONAL DESIGN AND CONSTRUCTION, INC., DATED JUNE 13, 2005, FOR THE PROJECT ENTITLED "GRAPELAND HEIGHTS PARK BALLFIELD COMPLEX, B-60496," FOR NECESSARY ENVIRONMENTAL SITE REMEDIATION WORK, IN AN AMOUNT NOT TO EXCEED $3,800,000, INCREASING THE AMOUNT OF THE AGREEMENT FROM $10,779,063 TO $14,579,063; ALLOCATING FUNDS FROM CAPITAL IMPROVEMENT PROJECT NO. B-60496, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 05-0137, adopted March 1, 2005, the City Commission authorized the City Manager to enter into a design/build agreement with Recreational Design & Construction, Inc. ("RDC"), for the project entitled Grapeland Heights Park Ballfield Complex," B-60496 ("Project"), in an amount not to exceed $5,997,063; and WHEREAS, pursuant to Resolution No. 05-0636, adopted November 3, 2005, the City Commission authorized the City Manager to execute Amendment No. 1 for the environmental remediation of the site; and WHEREAS, the City of Miami, in conjunction with RDC has determined that the extent of the contamination to the soil is greater than the preliminary test results showed; and WHEREAS, the Project cannot proceed further without remediation of the site as approved by Miami -Dade County Department of Environmental Resources Management; and WHEREAS, the Department of Capital Improvements and Transportation and RDC have agreed on the extent and the costs associated with the additional remediation; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute Amendment No. 2, in substantially the attached form, to the Agreement with RDC dated June 13, 2005, for the Project, for necessary environmental site remediation work, in an amount not to exceed $3,800,000, increasing the amount of the Agreement from $10,779,063 to $14,579,063, with funds allocated from Capital Improvement Project No. B-60496, for said purpose. Section 3. This Resolution shall become effective immediately upon its adoption and signature of City of Miami Page 1 of 2 File Id: 06-00179 (Version: 1) Printed On: 1/17/2017 File Number: 06-00179 Enactment Number: R-06-0121 the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
