AOA01 EXHIBIT "C" (GENERAL - with Safety Requirements) This exhibit forms an integral part of that certain Joint Participation Agreement between the State of Florida, Department of Transportation and CITY OF MIAMI 444 SW 2nd Avenue. Miami. Florida 33130-1910 dated Safety Requirements Bus Transit System - In accordance with Florida Statute 341.061, and Rule Chapter 14-90, Florida Administrative Code, the Agency shall submit, and the Department shall have on file, an annual safety certification that the Agency has adopted and is complying with its adopted System Safety Program Plan pursuant to Rule Chapter 14-90 and has performed annual safety inspections of all buses operated. _XX_ Fixed Guideway System - (established) In accordance with Florida Statute 341.061, the Agency shall submit, and the Department shall have on file, annual certification by the Agency of compliance with its System Safety Program Plan, pursuant to Rule Chapter 14-55. _XX.^ Fixed Guideway System - (new) In accordance with Florida Statute 341.061, the Agency shall submit a certification attesting to the adoption of a System Safety Program Plan pursuant to Rule Chapter 14- 55. Prior to beginning passenger service operations, the Agency shall submit a certification to the Department that the system is safe for passenger service. Program Funding & Project Requirements Department funding is provided from the Department's Intermodal Development Program. This project shall be conducted in accordance with the guidance for that program and with all applicable State of Florida Statutes. State participation rate is up to 66.3082% share of eligible project expenses. Department funding is provided solely for the Alternatives Analysis, Environmental Documentation, Preliminary Engineering and Program/Project Management associated with the proposed construction of 6,75 miles of track -way, maintenance facility and ancillary/support infrastructure. Eligible project expenses and budget amounts are shown on Attachment 1 to this Agreement. Attachment 2 shows the project study limits and proposed project locations. Agency personnel expenses and ail travel expenses shall not be eligible for reimbursement under this Agreement. No other costs incurred by the Agency shall be reimbursed by the Department. (GENERAL - with Safety Requirements) Purchasing, Payments & Reporting Requirements The Agency shall obtain prior written concurrence from the Department for any third party purchases exceeding $10,000. Failure to obtain prior concurrence may result in non-payment by the Department. The Agency must submit an invoice to the Department no later than one hundred and twenty days (120) after the period of services covered by said invoice. Failure to submit invoices in a timely manner may result in non-payment by the Department. Reimbursements to the Agency shall be made IAW the detailed project budget provided in Attachment 1. Changes to the project budget shall be made through a Supplemental JPA to the Original Agreement. Agency shall provide District Office with monthly reports on project and construction progress. Monthly reports must be in a format and media acceptable by Department. Failure to provide monthly reports may delay invoice payment by the Department. Environmental Documentation Requirements The project will be developed in conformance with all applicable State and Federal environmental laws and permitting requirements. If this project receives Federal financial assistance, the lead Federal agency will require that the Agency comply with the NEPA process. If this project is completed without Federal financial assistance, the National Environmental Policy Act (NEPA) process may not be applicable. In the absence of a Federally required examination of potential corridors or segments thereof, the Agency shall contact the Department to determine the scope of any additional environmental evaluation deemed necessary by the Department, such as a State Environmental Impact Report (SEIR). Other Requirements This is Multi -Year JPA with funding programmed in State Fiscal Year (SFY) 2007 which is subject to annual state legislative appropriation.
