HomeMy WebLinkAboutR-06-0118City of Miami Legislation Resolution: R-06-0118 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-00177 Final Action Date: 2/23/2006 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT A FUNDING COMMITMENT OF $1,013,380.26, FROM THE FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT") AND TO EXECUTE A JOINT PARTICIPATION AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH FDOT, FOR PROJECT NO. B-40666A, PROGRAMMED UNDER FINANCIAL PROJECT NO. 412473-1-52-01, FOR THE IMPLEMENTATION AND ADMINISTRATION OF LIGHTING IMPROVEMENTS TO BRICKELLAVENUE (STATE ROAD 5/U.S.-1), FROM SOUTH OF SOUTHEAST 25 ROAD TO SOUTHEAST 4 STREET, MIAMI, FLORIDA. WHEREAS, the Florida Department of Transportation ("FDOT") has an existing design and construction project on Brickell Avenue (State Road 5/U.S.-1) ("FDOT Project") from south of Southeast 25 Road to Southeast 4 Street, Miami, Florida ("Project Limits"), and programmed under Financial Project No. 412473-1-52-01, with construction funding to be allocated in Fiscal Year 2008- 2009; and WHEREAS, the FDOT Project consists of street and sidewalk lighting improvements, new signs, new sidewalks and new landscaping; and WHEREAS, FDOT requested that the City of Miami ("City") utilize the services of an engineering firm with lighting expertise to conduct a photometric analysis within the Project Limits to determine optimal illumination levels and to prepare a new lighting design in accordance with FDOT's design standards to provide improved street and sidewalk illumination and implementation of such design ("Project"), and is described in the Exhibit "A," attached and incorporated, detailing the Scope of Services; and WHEREAS, as a result of the photometric analysis, the lighting estimate was increased from the original estimate of $458,252.59 to $1,471,632.85, and WHEREAS, as a result of the difference between the old and new estimates, FDOT has opted to separate out the lighting improvements portion from the larger FDOT Project and programmed the funding for the difference between the two estimates under Financial Project Nos. 412473-2-58-01 (non -budgeted) and 412473-2-A8-01 (reimbursement phase); and WHEREAS, in order to expedite completion of the Project in advance of FDOT's 2005-2006 through 2009-1010, Five -Year Adopted Work Program, the City shall manage, supervise and inspect all aspects of Project construction until the Project is completed, and provide financial assistance for the Project in Fiscal Year 2006-2007, in accordance with Section 339.12, Florida Statutes; and WHEREAS, FDOT shall reimburse the City for eligible incurred Project expenses in future Fiscal Year 2008-2009, subject to the terms contained herein; and City of Miami Page 1 of 2 File Id: 06-00177 (Version: 1) Printed On: 1/13/2017 File Number: 06-00177 Enactment Number: R-06-0118 WHEREAS, the attached Joint Participation Agreement ("JPA") was negotiated with FDOT detailing the responsibilities of the City and FDOT for the Brickell Avenue Lighting Project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} accept a funding commitment of $1,013,380.26, from FDOT and to execute a JPA, in substantially the attached form, with FDOT, for Project No. B-40666A, programmed under Financial Project No. 412473-1-52-01, for the Project, from South of Southeast 25 Road to Southeast 4 street, Miami, Florida. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
