MARTIN LUTHER KING JR. BOULEVARD COMMERCIAL DISTRICT; IN ORDER TO MODIFY THE INTENT OF THE DISTRICT, ADD REQUIREMENTS FOR STREETSCAPE AND FACADE IMPROVEMENTS TO BE REQUIRED BY CLASS 1I SPECIAL PERMIT FOR EXTERIOR WORK INCORPORATED BY REFERENCE THE "DR. MARTIN LUTHER KING, JR. BOULEVARD STREETSCAPE BEAUTIFICATION MASTER PLAN AND FACADE STANDARDS", HERE AND AFTER REFERRED TO AS THE "MLK BOULEVARD STREETSCAPE PLAN AND FACADE STANDARDS;" CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in March 2004 a planning process was initiated Planning and Zoning Department; and WHEREAS, in June 2004 , the Kimsey -Horn and Associates, Inc., consulting team, was hired by the Planning Department to produce the MLK Boulevard Streetscape Plan and Facade Standards; and WHEREAS, in October 2004-March 2005, through the MLK Ad -Hoc Council and subcommittees, a series of committee meetings were held in reference to the Martin Luther King Boulevard Corridor; and WHEREAS, on April 6, 2005 the MLK Ad -Hoc Council adoptions the MLK Boulevard Streetscape Beautification Master Plan and Facade Standards; and WHEREAS, ON June 22, 2005 the MLK Ad -Hoc Council with the City of Miami hosted a Community Meeting on the MLK Boulevard Streetscape Beautification Master Plan and Facade Standards; and WHEREAS, the Planning Advisory Board, at its meeting of June 29, 2005, Item No. 6, following an advertised hearing, adopted Ordinance No. PAB 74-05 by a vote of seven to zero (7-0), RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the Planning Department recommended approval of the study; and WHEREAS, the herein Ordinance has been the subject of a properly advertised public hearing before the City Commission; City of Miami Page 1 of 4 Printed On: 1/10/2006 File Number:: 05-00651 NOW, THEREFORE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The members of the Miami City Commission approve the MLK Boulevard Streetscape Plan and Facade Standards as a guiding tool for existing and future development and creating an image for the corridors character and the continued economic vitality of this significant corridor as defined in the MLK Boulevard Streetscape Plan and Facade Standards. Section 3. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by amending the text of said Ordinance as follows: {1} Sec. 601. SD-1 Dr. Martin Luther King Jr, Boulevard Commercial District. Sec. 601.1. Intent. This district is of special and substantial public interest because of the need to develop and redevelop in a manner improving amenity, efficiency, and security. These regulations are intended to encourage concentration of commercial and service facilities at intersections of arterials streets, encourage residential development above such facilities and in areas away from such intersections and to provide the development and design opportunities inherent in larger site areas. It is intended that Dr. Martin Luther King Jr. Boulevard be: A place that provides a mix of learning, living, working, shopping and entertainment in a Tropical Afrocentric Caribbean atmosphere. A place that is active, lively, and provides a distinctive urban lifestyle that reinforces Miami's multi -cultural and multi -generational characteristics. A place which combines a variety of buildings. heights, shapes, with land uses geared to pedestrians; encourages window shopping, outdoor cafes, restaurants, and human interaction along wide sidewalks, plazas, open spaces, balconies and arcades. A place that provides connections to Model City/Liberty City from Downtown Miami (via 1-95 and US 441), and from the Upper Eastside/Biscayne Boulevard to the City of Hialeah (via Dr. ML King Jr. Boulevard), A place that provides adequate parking, discourages the use of the automobile parking at ground floor, A place that has attractive colors, materials, lighting, and landscaping and that is safe to the public welfare. A place that provides a variety of affordable housing for all income and age groups that provides residents, visitors and tourists with a variety of 24 hour services, including among others: restaurants, entertainment, cultural, and specialty retail establishments. A neighborhood corridor that reinforces the messages and teachings of Dr. Martin Luther King, Jr., and the cultures of all people of the African Diaspora, including its music, cuisine, art, and tradition. A Class I1 Special Permit shall be required prior to approval of any permit except special permit pursuant to article 13) affecting the height, bulk, location or exterior configuration of any existing building visible from the right-of-way, or for the erection of a new building; or for the location, relocation or alteration of any structure, parking area or vehicular way visible from a public street. 601.3.2. Consideration in Making Class II Special Permit determinations. 1) The purpose of the Class II Special Permit shall be to ensure conformity of the application with the expressed intent of this district, with general considerations listed in section 1305, and with the special consideration listed below, including the MLK Boulevard Streetscape Plan and Facade Standards incorporated herein by reference. 2) All signs, awnings and storefront renovations shall be of a style and/or size which is consistent with the MLK Boulevard Streetscape Plan and Facade Standards. 3) Wherever feasible, lot frontage along Martin Luther King Boulevard and NW 7th Avenue should be developed in accord with the MLK Boulevard Streetscape Plan and Facade Standards, and the design standards and guidelines in the "City of Miami's Primary Pedestrian Pathway Design Guides and Standards." *11 Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof. {2} APPROVED AS TO FORM AND CORRECTNESS: JORGE L.
