AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ARTICLE 9,
SECTION 917.14 OF ORDINANCE NO, 11000, AS AMENDED, THE ZONING
ORDINANCE OF THE CITY OF MIAMI, BY MODIFYING REGULATIONS RELATED
TO PARKING LIFTS IN ORDER TO AMEND THE TITLE OF THE SECTION FROM
"PARKING LIFTS" TO "AUTOMATED PARKING"; ADDING PROVISIONS FOR
ROBOTIC AND OTHER MECHANICAL MECHANISMS TO PROVIDE PARKING BY
SPECIAL PERMIT; PROVIDING FOR CRITERIA, PROVIDING FOR AN
APPLICATION AND APPROVAL PROCESS; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting of October 12, 2005, Item No.2,
following an advertised public hearing, adopted Resolution No. PAB 102-05 by a vote of eight to zero
(8-0), recommending APPROVAL of amending Ordinance No. 11000, as amended, as hereinafter set
forth; and
WHEREAS, the City Commission after careful consideration of this matter deems it advisable and
in the best interest of the general welfare of the City of Miami and its citizens to amend Ordinance No.
11000, as amended, as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORI DA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby
adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami is hereby
amended by amending Article 9, General and Supplementary Regulations, as follows: {1}
ARTICLE 9. GENERAL AND SUPPLEMENTARY REGULATIONS
917.14. Par -king -Lifts Automated Parking.
917.14.1. Parking Lifts, Robotic and Mechanical parking systems.
Parking lifts. For the purposes of this section, "Parking Lifts, Robotic, Automated and Mechanical
parking systems " shall be defined as an electro-hydraulic or other automated mechanisms that lifts a
pares vehicles to either make space available to park a other vehicles below it in a vertical tandem
fashion, or mechanically accommodates vehicles into their parked locations by an operator.

Where parking of vehicles is to be located within a garage structure, excluding the R-1 and R-2
zoning districts, a mechanical, robotic, automated or parking lift system, as defined herein, shall be
permissible pursuant to a Class II Special Permit, subject to the following criteria:
1. Such parking shall be located within the garage so that a visual barrier is in place to screen the
parking from pedestrian view;
2. The parking lift's platform (for parking lift systems) width and length should cover the bottom of
the car to prevent dripping down to the bottom car;
3. Due to the stacked nature of this form of parking, when it is being used for residential purposes,
the sharing of parking in this sort of vertical tandem fashion shall only be allowed for self -parking for
residents within the same unit (i.e. spouses, roommates, etc.); such spaces (including robotic or
automated systems) can only count towards required parking for any provided use, or for residents
from different units, when the applicant provides a mandatory valet service that shall be required to be
operated 24 hours per day/ 7 days per week.
4. All proposed key switch mechanisms (when so provided) shall be spring loaded for safety
purposes.

Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the
provisions of this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty (30) days after final reading and adoption
thereof. {2}
Section 6. All existing non -permitted Murals shall be removed within sixty (60) days of the effective
date unless an initial application has been filed with the City's Hearing Administrator in accordance
with the provisions of this Ordinance.

{2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within
ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall
become effective immediately upon override of the veto by the City Commission or upon the
effective date stated herein, whichever is later.
