Amendment to Article 6 of Zoning Ordinance 11000

Consideration of an Ordinance of the Miami City
Commission amending Ordinance No. 11000, as
amended, the Zoning Ordinance of the City of Miami,
Florida, by amending Article 6, Section 627 Midtown
Miami Special District, more particularly the SD-27.1
Midtown Miami East Special District; Section 627.1.6 in
order to modify provisions related to upper level balcony
encroachments into setback and build -to areas;
containing a repealer provision and severability clause;
providing for transmittal to state agencies as required by
law; and providing an effective date.
Approval.
The proposed amendment is in order to correct a
scrivener's error in the allowable encroachments of
balconies and awnings in the SD-27.1 Midtown Miami
East Special District. The ordinance was originally
adopted with an encroachment allowance of 7 feet for
awnings and 3 feet for balconies. The most recent
amendment shows the 3 foot language as missing when
it should have been shown as stricken. This amendment
will clean that up and allow for the wider balcony
encroachments as for the awnings. This amendment will
allow such balconies to be more user-friendly and help
create a livelier pedestrian atmosphere. (See attached).
