The Code Enforcement Board was created to issue orders having the force of law commanding
whatever steps are necessary to bring a Code violation into compliance.
Florida Statutes Section 162.05(2) requires members of the Code Enforcement Board to be
residents of the City of Miami. City Code Section 2-812 states that whenever possible, the
board is to consist of an architect, a businessperson, an engineer, a general contractor, a
subcontractor, and a realtor.
Five appointments are needed at this time for terms that will expire on February 12, 2006, two of
which have excessive absences:
• Chairman Gonzalez has one nomination for regular seat currently held by Richard
Tapia, who has exceeded the number of absences allowed per City Code (10 absences in
2005)*.
• Vice Chairman Winton has one nomination for regular seat currently held by Steven
Baird.
• Commissioner Regalado has one nomination for regular seat currently held by Hugh
Ryan.
• Commissioner Spence -Jones has one nomination for regular seat currently held by
James Moss, who has exceeded the number of absences allowed per City Code (5
absences in 2005)*.
• The Commission At Large has one appointment for regular seat currently held by
Charles McEwan.
Commissioner Sanchez has an appointment for regular seat wherein Luis Carlos Alvarez
was appointed on December 15, 2005. Numerous attempts to contact Mr. Alvarez
regarding his appointment have been unsuccessful.
For your convenience, we have included a copy of the current membership of said board. By copy
of this memorandum, we are requesting the Agenda Office to place this issue on the February 9,
2006 Commission agenda. (*) These matters were deferred from the November 3, 2005 and
December 15, 2005 Commission Meetings.
