HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fl.us File Number: 06-00121 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING THE RELEASE OF A TEN-YEAR AFFORDABILITY RESTRICTIVE COVENANT FOR TEN PARCELS OF LAND, DESCRIBED IN ATTACHMENT "A," ATTACHED AND INCORPORATED, THAT ARE BEING DEVELOPED BY HABITAT FOR HUMANITY OF GREATER MIAMI, INC. ("HABITAT"), FOR AFFORDABLE HOUSING; AUTHORIZING AN AFFORDABILITY RESTRICTIVE COVENANT TO BE IMPOSED ON THE NINE PARCELS OF LAND, DESCRIBED IN ATTACHMENT "B," ATTACHED AND INCORPORATED, TO BE CONVEYED TO HABITAT; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A PARTIAL RELEASE OF DECLARATION OF RESTRICTIVE COVENANTS, IN SUBSTANTIALLY THE ATTACHED FORM, AND ANY ADDITIONAL NECESSARY DOCUMENT(S), FOR SAID PURPOSE. WHEREAS, the ten parcels of land described in Attachment "A," attached and incorporated, are subject to a ten-year affordability restrictive covenant in favor of the City of Miami ("City") that was agreed to by Scattered Site Home Ownership, L.L.C., a Florida limited liability company, the former owner of said property; and WHEREAS, one of those parcels is also subject to a fifteen -year affordability restrictive covenant in favor of the City that was subsequently imposed in the City Deed conveying the property to Habitat for Humanity of Greater Miami, Inc. ("Habitat"); and WHEREAS, in connection with the conveyance of the remaining nine parcels to Habitat, described — = - -' #taded cmdiffeorporated, HaE ita#-1 #hh 't fA. , affordability restrictive covenant; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The release of a ten-year affordability restrictive covenant for ten parcels of land, described in Attachment " A," attached and incorporated, that are being developed by Habitat for affordable housing, is approved. Section 3. An affordability restrictive covenant for the nine parcels of land described in Attachment "B," attached and incorporated, to be conveyed to Habitat, is authorized. Section 4. The City Manager is authorized{1 } to execute a Partial Release of Declaration of Restrictive Covenants, in substantially the attached form, and any additional necessary document(s), for said purpose. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPVEO FORM AN S-+"ECTNESS:t" Footnotes: {1 } The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
