HomeMy WebLinkAboutR-06-0074City of Miami Legislation Resolution: R-06-0074 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-00102 Final Action Date: 2/9/2006 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, WITH DADE HERITAGE TRUST, INC. ("TRUST"), A NON-PROFIT ORGANIZATION, TO ALLOW THE TRUST TO RENOVATE THE OLD MIAMI HIGH SCHOOL HISTORIC BUILDING ("BUILDING") LOCATED APPROXIMATELY AT 140-142 SOUTHWEST 11TH STREET, MIAMI, FLORIDA, ALSO KNOWN AS SOUTHSIDE PARK ("PROPERTY"), FOR THE PURPOSE OF RESTORING AND RENOVATING SAID BUILDING ("PROJECT") AT THE PROPERTY, FOR A PUBLIC PURPOSE USE; AUTHORIZING THE CITY MANAGER TO ACCEPT THE USE OF A GRANT AND OTHER FUNDS, IN THE AMOUNT NOT TO EXCEED $700,000, CONSISTING OF AWARDS TO THE TRUST FOR SAID PROJECT; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A RESTRICTIVE COVENANT REQUIRED BY THE FLORIDA SECRETARY OF STATE, WITH TERMS AND CONDITIONS MORE PARTICULARLY SET FORTH IN SAID AGREEMENT; FURTHER AUTHORIZING THE CITY MANAGER TO AMEND SAID AGREEMENT AS NECESSARY. WHEREAS, the City of Miami ("City") is the owner of certain real property and improvements located at 140-142 Southwest 11th Street, Miami, Florida, also known as Southside Park ("Property"); and WHEREAS, the City approved the relocation of the Old Miami High School, also known as First Miami High School ("Building") by Dade Heritage Trust, Inc. ("Trust"), to a certain portion of the Property for public use; and WHEREAS, the Trust was awarded a total of $350,000 in grant funds from the State of Florida Secretary of State and $350,000 from the Miami -Dade County General Obligation Bond for use in the restoration and renovation of the Building; and WHEREAS, a condition of the State of Florida Secretary of State grant is the execution of a restrictive covenant providing for compliance with historic usage of the Building for a period of ten (10) years; and WHEREAS, the City and the Trust desire and intend to enter into this Agreement to allow the Trust to oversee and implement the renovation of the Building from predevelopment renovation stages, to receipt of a certificate of occupancy for said Building; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The City Manager is authorized{1} to execute an Agreement, in substantially the attached form, with the Trust, a non-profit organization, to allow the Trust to oversee and complete the implementation of the restoration and renovation of the Building located approximately at the Property, for a public purpose use. Section 3. The City Manager is authorized{1} to accept the use of a grant and other funds, in the amount not to exceed $700,000, consisting of awards to the Trust, for said project. Section 4. The City Manager is further authorized{1} to execute a restrictive covenant required by the Florida Secretary of State grant, providing for compliance with historic preservation regulations for a period of ten (10) years, with terms and conditions set forth in said Agreement. Section 5. The City Manager is further authorized{1} to amend said Agreement as necessary. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
