Emergency Finding: Execution to ratify and

for the Hadley Park Community Center Project

This memo serves to request your authorization for a "Finding of an Emergency" for the
execution of Amendment Nos. 1, 2, 3 and 4 for the Agreement between the City and the
Department of Management Services ("DMS") for the construction of the Hadley Park
Community Center Project. The amendments increase the Agreement amount from $2,400,000
to a total of $4,132,356.
On June 28, 1999, the City entered into an Agreement with DMS for the oversight of the design
and construction of improvements at Hadley Park Community Center, at a value of $2,400,000.
The City Commission through approval of Ordinances 11909, 12087, and Resolution 00-825
increased the available funding to $3,582,636. Subsequent to those approvals the City
Manager entered into three amendments to the Agreement increasing the project budget to
$3,954,636. DMS recently submitted a request to the City for Amendment No. 4, an additional
increase, in the amount of $177,720 to close out all remaining pending change orders with the
Contractor and make final payment to the Contractor. CIP met with DMS to discuss the
requested Amendment, and DMS certified the accuracy and validity of the requested change
orders. The construction was completed on January 31, 2003.
In the past, change orders for this Project were processed without proper approval by the City
Commission. When Amendment No. 4 was presented for execution, the Department
researched the history of the Project and realized that all of the prior amendments, and
Amendment No. 4, need to be approved and ratified by the City Commission. Currently, the
only mechanism for the City to officially ratify these amendments and pay DMS for this
previously completed work is via an "Emergency Finding."
Please indicate your approval of the "Emergency Finding" to authorize the above described
action for the Amendments. This "Emergency Finding" will be placed on the January 26, 2006
Commission agen for ratific- n-end approv- by the City Commission.
