Subject: Termination for Default of August Construction Company, Inc. on Project B-50650, Riverview
Stormwater Pump Station Upgrade
Purpose of Item:
To authorize the City Manager to terminate the contract with, August Construction Company Inc. for
default and to further authorize the City Manager to obtain pricing for completion of the work, hold
August Construction Company, Inc. liable for the costs incurred in having the project completed, and
proceed with action against August Construction Company Inc.'s performance and payment bond.
Background Information:
The City Commission awarded a contract to August Construction Company, Inc. on April 22, 2004
for the Riverview Stormwater Pump Station Upgrades Project, B-5056A. During August 2005,
August Construction stopped work on the project due to the owner of the company being hospitalized.
Subsequently, the Department of Capital Improvements & Transportation ("Department") received
notification that due to the owner's hospitalization August Construction Company, Inc. would not be
I able to resume work until November 2005. The Department requested that a recovery action plan for
completion of the project be submitted by no later than October 17, 2005. August Construction failed
to submit the recovery plan and has not provided any additional information on their ability to
complete the project.
To expedite the completion of this project it is, therefore, necessary for the City to terminate the
contract with August Construction Company, Inc. for default and contract with another contractor.
