HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, EL 33133 www,ci.miami.fl.us Final Action Date: File Number: 05-01416 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A LOCALLY -FUNDED JOINT PARTICIPATION AGREEMENT, WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT"), AND A MEMORANDUM OF AGREEMENT WITH FDOT AND THE FLORIDA DEPARTMENT OF FINANCIAL SERVICES, DIVISION OF TREASURY ("TREASURY"), IN SUBSTANTIALLY THE ATTACHED FORM(S), FOR ND AVENUE FROM NORTHEASTCONSTRUCT STREETSCAPE PROVEMENTS ALONG 3TH TO NORTHEAST NORTHEAST 214TH STREETS, MIAMI, FLORIDA, AS PART OF CAPITAL IMPROVE' AND PROJECTO NO. B-30361 "PAC SUPER BLOCK STREETSCAPE PROJECT, AUTHORIZE PAYMENT TO THE TREASURY ON BEHALF OF FDOT IN AN AMOUNT NOT TO EXCEED $264,525; ALLOCATING FUNDS FROM THE COMMUNITY REDEVELOPMENT AGENCY OMNI TAX INCREMENT FUND, ENTITLED "CONSTRUCTION 6B 30361 FOR SAID PURPOSE. CODE NO. 686001.59032 WHEREAS, the Community Redevelopment Agency ("CRA") has asked the Department of Capital Improvements and Transportation ("Department") w Performing Arts Center ("PAC"),ssist in implementing consisting g of milling is in all roads surrounding and leading to and resurfacing, curb and gutter replacement, sidewalk repairs and installation of sidewalk pavers, signage and decorative lighting ("Improvements"); and WHEREAS, the City of Miami ("City") and interested parties are eager to have the Improvements completed by the soft opening of the PAC in August, 2006; a WHEREAS, the CRA's request has been approved by action of the Board of Directors of the Omni CRA, and funds for the CRA ImprovementsResolution NoeDS-D047, adopted November ti3 on 2005�and021, adopted May 26, 2005 and by CRA WHEREAS, to minimize conflict with multiple contractors working within the same area, the Department has sought the cooperation Mucitioni-Dade ont acts inty henvicinity of the Improvements; and the Florida Department of Transportation ("FDOT") for existing construction WHEREAS, FDOT has an existing construction project on Northeast 2nd Avenue that includes the area from Northeast 13th to Northeast 14thSttrees, Miami, Florida,2006; anogrammed as State Financial Project No. 251688-2-52-01, and scheduledbeginMarch, d WHEREAS, FDOT has agreed to modify its existing construction contract to add the streetscape improvements requested by the Department, landscaRA and PAC, Welat d workconsist (hereinafter thet°2nd and/or installation of new lighting, sidewalk pavers, landscaping and Avenue Streetscape Improvements") based on construction documents furnished by the Department; and City of Miami Page 1 of 3 Printed On: 12/2/2005 File Number: 05-01416 WHEREAS, the attached Locally -Funded Joint Ct respective responsibilities es otion f the City andreement the he FDOT for the work, s been negotiated with FDOT and details the p as well as subsequent maintenance responsibilities once the Improvements are completed, including the CRA's commitment to maintain the decorative lighting; and WHEREAS, the Agreement requires that the City provide funds for the 2nd Avenue Streetscape Improvements to FDOT, in advance, which funds a eto be f of FDOT,held asb the Fllorida n t Department of Financial Services, Division of Treasury ("Treasury") on beMemorandum of Agreement governing the Treasury's fiscal administration of City funds for the work; and WHEREAS, the Agreement provides for FDOT to return to City any funds not used on the 2nd Avenue Streetscape Improvements; and WHEREAS, the funds in the amount of $264,525 are available from the CRA's Omni Tax Increment Fund, entitled "Construction In Progress," Account Code No. 686001.590320.6.860, B-30361, for this purpose; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF M1AMI, FLORIDA: Section 1. The recitals and findings contained the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Secion. Section 2. The City Manager is authorized {1} to execute an Agreement with FDOT and a Memorandum of Agreement with FDOT and along e asury, in Avenuellly the attached form(s), from Northeast 13thfor to FDOT to construct streetscape improvements Northeast 2nd Northeast 14th Streets, Miami, Florida, as part of Capital Improvement Project No. B-30361, "PAC Super Block Streetscape Project," and is authorized funds allocated from the CRA Omni Taxto make payment to the Treasury on encrement half of FDOT, in an amount not to exceed $2 , Fund, entitled "Construction In Progress," Account Code No. 686001.590320.6,860, B-30361, for said purpose Section 3.
