B-72910, ARE, IN RANK ORDER: (1) SPILLIS CANDELA DMJM, AND (2) ZYSCOVICH, INC; AUTHORIZING THE CITY MANAGER TO NEGOTIATE A PROFESSIONAL SERVICES M"FURTHEREAUTHORIZING WITH THE CITY CANDELA DMJM, THE TOP -RANKED FIR MANAGER TO NEGOTIATE AN AGREEMENT WITH THE SECOND -RANKED FIRM 1N THE EVENT NEGOTIATIONS FAIL WITH THE TOP -RANKED FIRM; DIRECTINGTHE CITY MANAGER TO PRESENT THE NEGOTIATED THE CITY COMMISSION FOR CONSIDERATION AND AGREEMENT TO APPROVAL. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. ings of the Section 2. Section 3. The City Manager is authorized(1} to negotiate an Agreement with Spillis Candela DMJM, the highest -ranked firm. Section 4. The City Manager is further authorized(1) to negotiate an Agreement with the second -ranked firm in the event negotiations fail with the top -ranked firm. Section 5. The City Manager is directed to present the negotiated Agreement to the City Commission for consideration and approval. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS/ Footnotes: {1} The herein authorization is further subject to compliance by applicable City Charter and Coded by the City Attorney, including but not limited to thoseprescribed provisions. {2} If the Mayor does not sign this Resolution, it shall bee effective at the end of ten calendar days this Resolution, it shall become effective from the date it was passed and adopted.
