S. MAIL Ms. Alicia Cuervo-Schreiber Chief of Operations City of Miami Tenth Floor Miami Riverside Center 444 S.W. Second Avenue Miami, Florida 33130 RE: Davis Heritage Ltd. Conveyance to City of Land for Right -of -Way Dear Alicia: Thank you and Stephanie for meeting with me about the above -referenced matter. Pursuant to your request, 1 am forwarding a copy of the letter received from Miami -Dade County Right -of -Way Division regarding the creation/connection of existing North Bayshore Drive to 27 Street. Following the instructions of Mary Conway and Stephanie Grindell, I approached the County by calling the office of the Assistant County Manager, Pete Hernandez. After explaining the issue, I was referred to Mohammed Hasan in the Traffic Division. After a lengthy conversation with Mr. Hasan and his full and complete understanding of what my clients wished to accomplish, Mohammed advised me that his division would be involved only in reviewing construction plans for the street for purposes of meeting the physical requirements of the street such as curb, materials, dimensions, signage, etc. As a result, he referred me to the Right -of - Way Division and, in fact, placed a conference call to the Right -of -Way Division and stayed on the line with Mr. Lacau and me. As a result of this conference call, Mr. Fernando Alonso, as head of Right -of -Way, issued the enclosed letter. BILZIN SUMBERG BAENA PRICE & AXELROD LLP Ms. Cuervo-Schreiber October 7, 2005 Page 2 I was pleased to hear from you and Stephanie that the City supports the connection of the street. This is consistent with the position of the Planning Department and the Department of Public Works of about eighteen (18) months ago when the Class II was issued by the City, approving the Lyght project with its frontage on the proposed new right-of-way extension and consistent with my conversations last week with Ana Gelabert-Sanchez. I also am happy to report that the Edgewater Homeowners' Association not only supports the extension of North Bayshore Drive but, through its President, Armando Rodriguez, has expressed its support to Mayor Diaz and Commissioner Winton. The only concern of the Homeowners' Association is the delay in accomplishing this goal. I would respectfully request that you expedite this matter and schedule the same for a Commission meeting to accept the conveyance of the land to the City. Should you require any additional information, please do not hesitate to contact my office. For your information, a deed to convey the property was forwarded to the City on March 30, 2005.
