HomeMy WebLinkAboutR-05-0728City of Miami Legislation Resolution: R-05-0728 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 05-01421 Final Action Date: 12/15/2005 A RESOLUTION OF THE MIAMI CITY COMMISSION ACCEPTING THE RECOMMENDATIONS OF THE COCONUT GROVE BUSINESS IMPROVEMENT COMMITTEE, PURSUANT TO SECTIONS 2-1251 AND 54-341(D) AND (E) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CODE"): (1) WAIVING THE 120-DAY APPLICATION SUBMISSION DEADLINE AND APPROVING THE APPLICATION FOR EVENTS OCCURRING IN THE COCONUT GROVE SPECIAL EVENTS DISTRICT, FOR THE 2005 KING MANGO STRUT, (2) AWARDING A GRANT IN THE AMOUNT OF $11,388.12, OF WHICH $2,500, WILL BE USED TO CONTINUE TO PROVIDE ENTERTAINMENT AFTER THE PARADE WITHIN THE COCONUT GROVE SPECIAL EVENTS DISTRICT, AND 3) AUTHORIZING AND DIRECTING THE DEPARTMENT OF OFF-STREET PARKING ("DOSP") TO DISBURSE FUNDS IN THE TOTAL AMOUNT OF $11,388.12, FROM THE COCONUT GROVE SPECIAL EVENTS AND MARKETING TRUST FUND, ACCOUNT NO. 1000000860261, IN SUPPORT OF THE 2005 KING MANGO STRUT, PURSUANT TO SECTIONS 2-1251 AND 54-343(4) OF THE CODE; FURTHER AUTHORIZING AND DIRECTING DOSP TO EXECUTE ANY NECESSARY DOCUMENTS FOR SAID PURPOSES. WHEREAS, pursuant to Sections 2-1251 and 54-341(d) and (e) of the Code of the City of Miami, Florida, as amended ("Code"), (1) due to delays caused by Hurricanes Katrina and Wilma, the Special Events Committee and the Executive Committee of the Coconut Grove Business Improvement Committee ("BIC") on December 2, 2005 voted to recommend to the Miami City Commission to waive the 120-day application deadline for the 2005 King Mango Strut planned to occur in Coconut Grove on December 31, 2005, and (2) on November 15, 2005 the BIC voted to recommend to the Miami City Commission: (a) to approve the application for the 2005 King Mango Strut to occur in the Coconut Groves Special Events District during December 2005, (b) to award a grant in the amount of $11,388.12, to the 2005 King Mango Strut, of which $2,500, will be used to continue to provide entertainment after the parade within the Coconut Grove Special Events District, and (c) to disburse funds in the total amount of $11,388.12, from the Coconut Grove Special Events and Marketing Trust Fund Account No. 1000000860261, in support of the 2005 King Mango Strut; and WHEREAS, Sections 2-1251 and 54-343(4) of the Code require any disbursement of funds from the Coconut Grove Special Events and Marketing Trust Fund to be made by the Department of Off -Street Parking ("DOSP"); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The recommendations of the BIC, pursuant to Sections 2-1251 and 54-341(d) and (e) of the Code: (1) waiving the 120-day application deadline and approving the application for events occurring in the Coconut Grove Special Events District, for the 2005 King Mango Strut, (2) awarding a grant in the amount of $11,388.12, to the 2005 King Mango Strut, of which $2,500, will be used to continue to provide entertainment after the parade within the Coconut Grove Special Events District, and (3) authorizing and directing DOSP to disburse funds, pursuant to Sections 1251 and 54-343(4) of the Code, in the amount of $11,388.12, from the Coconut Grove Special Events and Marketing Trust Fund Account No. 1000000860261, in support of the 2005 King Mango Strut, to be held in the Coconut Grove Special Events District, are authorized. Section 3. DOSP is further authorized and directed to execute any necessary documents for said purposes. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
