A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING THE BID OF TEXAS AQUATIC HARVESTING, INC., THE LOWEST
RESPONSIVE AND RESPONSIBLE BIDDER PURSUANT TO INVITATION FOR
BIDS, DATED SEPTEMBER 26, 2005, FOR THE PROJECT ENTITLED "CITYWIDE
CANAL AND WATERWAY MAINTENANCE, 2ND BIDDING, B-30255," FOR A
TWO-YEAR PERIOD, IN THE TOTAL AMOUNT NOT TO EXCEED $1,924,960, AS
SET FORTH ON THE FORMAL BID DOCUMENT, ATTACHED AND
INCORPORATED, WITH THE OPTION TO RENEW FOR THREE (3) ADDITIONAL
ONE-YEAR PERIODS ; ALLOCATING FUNDS FROM PUBLIC WORKS GENERAL
FUNDS ACCOUNT NO. 001000.311003.6.340; AUTHORIZING THE CITY
MANAGER TO EXECUTE A CONTRACT, IN SUBSTANTIALLY THE ATTACHED
FORM, FOR SAID PURPOSE.
WHEREAS, the Administration has received bids for construction services for the project entitled
"Citywide Canal and Waterway Maintenance, 2nd Bidding, B-30255," pursuant to formal invitation for
bids dated September 26, 2005; and
WHEREAS, Cs necessary to execute a contract, in substantially the attached form, for said
purpose; and
WHEREAS, Texas Aquatic Harvesting, Inc., is the lowest responsive and responsible bidder
pursuant to formal Invitation for Bids, opened and received by the Office of the City Clerk on
September 26, 2005, at 10:00 a.m., in the amount of $1,924,960; and
WHEREAS, funds to cover the total construction costs not to exceed $1,924,960, for expenses and
other costs to be incurred by the City of Miami are available from Public Works Account No.
001000.311003.6.340;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The bid of Texas Aquatic Harvesting, Inc., the lowest responsive and responsible bidder
pursuant to Invitation for Bids, dated September 26, 2005, for the project entitled "Citywide Canal and
Waterway Maintenance, 2nd bidding, B-30255," for a two-year period, in the total amount not to
exceed $1,924,960, as set forth on the formal bid document, attached and incorporated, with the option
to renew for three (3) additional one-year periods, is accepted, with funds allocated from Public Works
General Funds Account No. 001000.311003.6.340.
Section 3. The City Manager is authorized{1} to execute a contract, in substantially the attached
form, for said purpose.

Section 4. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10} calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
