HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fl.us File Number: 05-01417 Final Action Date: A RESOLUTION OF THE CITY OF MIAMI COMMISSION, BY A FOUR -FIFTHS (415THS) AFFIRMATIVE VOTE, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S EMERGENCY FINDING; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES, PURSUANT TO SECTION 18-90 OF THE CODE OF THE CITY OF MIAMI, FLORIDA; AUTHORIZING AN AWARD OF A CONTRACT TO MARINA POWER, INC., FOR THE PURCHASE OF SLIP UTILITY PEDESTALS, ELECTRICAL POWER TRANSFORMERS AND FIRE SUPPRESSION STATIONS, FOR DINNER KEY MARINA AND MIAMARINA, WHICH WERE DESTROYED OR LOST AS A RESULT OF HURRICANE WILMA, IN AN AMOUNT NOT TO EXCEED $62,412; ALLOCATING FUNDS FROM THE HURRICANE WILMA ACCOUNT CODE 800007.350603.6.670. WHEREAS, the City of Miami's ("City") Dinner Key Marina and Miamarina suffered extensive damage as a result of Hurricane Wilma particularly to the slip pedestals, fire suppression stations and power transformers at both marinas, which provide electrical, water, telephone and CAN services to customers' vessels at both of the marinas; and WHEREAS, the damaged or destroyed slip pedestals and power transformers also house the fire alarm pull boxes, fire hoses and fire extinguishers on the docks to over seven hundred customers' vessels for customer safety; and WHEREAS, the Department of Public Facilities finds and determines that it is in the best interest of the City to expedite the purchase and installation of the replacement slip pedestals, transformers and fire suppression stations in order to repair the vital infrastructure and to return basic utility to its marina customers; and WHEREAS, the Department of Public Facilities has identified Marina Power, inc., as the manufacturer and certified sole source provider of this equipment and replacement components; and WHEREAS, this project is projected to cost $62,412 for both marinas and will be submitted to the Florida Emergency Management Agency to recover the reimbursable project cost; and WHEREAS, the Department of Public Facilities has determined the most expeditious method to proceed with the replacement process is to waive the competitive sealed bidding procedure as provided in Section 18-90 of the Code of the City of Miami, Florida, as amended ("City Code"); and WHEREAS, said findings of the City Manager has been duly considered and adopted by the City Commission; NOW THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 Printed On: 12/6/2005 File Number: 05-01417 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, the City Manager's emergency finding, waiving the requirements for competitive sealed bidding procedures, pursuant to Section 18-90 of the City Code, is ratified, approved and confirmed and the purchase of slip utility pedestals, electrical power transformers, and fire suppression stations for Dinner Key Marina and Miamarina, which were destroyed or lost as a result of the damage from Hurricane Wilma, from Marina Power, Inc., in an amount not to exceed $62,412, is authorized, with funds allocated from the Hurricane Wilma Account Code 800007.350603.6.670. Section 3. This resolution shall be effective immediately upon its adoption and signature of the Mayor. {1} APPROVED AS TO FORM AND CORRECTNESS: JORGE L. FERNANDEZ CITY ATTORNEY Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
