HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miaml.fl.us File Number: 05-01321 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGERS EMERGENCY FINDING; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES, PURSUANT TO SECTIONS 18-89 AND 18-90 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AUTHORIZING AN AWARD OF A CONTRACT TO SHORELINE FOUNDATION INC., FOR THE PURCHASE AND INSTALLATION OF 49,538 SQUARE FEET OF HIGH QUALITY FIBERGLASS DECKING, WHICH WILL REPLACE THE EXISTING CUSTOM IPE HARDWOOD, OF WHICH APPROXIMATELY 55% WAS DAMAGED OR LOST AS A RESULT OF HURRICANE WILMA, IN AN AMOUNT NOT TO EXCEED $1,129,466.40; ALLOCATING FUNDS FROM VARIOUS CAPITAL PROJECT ACCOUNTS, SUBJECT TO BUDGETARY APPROVAL. WHEREAS, the City of Miami's ("City") Dinner Key Marina suffered extensive damage as a result of Hurricane Wilma which affected approximately 55% of the custom Ipe hardwood pier decking; and WHEREAS, the City's Department of Public Facilities finds and determines that it is in the best interest of the City to expedite the purchase and installation of replacement decking to provide structural stability for Dinner Key Marina's piers and docks, and WHEREAS, the City's Department of Public Facilities with the assistance of the City's Department of Capital Improvements and Coastal Systems International, Inc., an outside engineering consultant, has identified a high quality extremely durable fiberglass decking replacement alternative to the existing hardwood; and WHEREAS, the City's Department of Public Facilities has determined the most expeditious method to proceed with the replacement process is to waive the competitive sealed bidding procedure as provided in Sections 18-89 and 18-90 of the Code of the City of Miami, Florida as amended ("City Code"), and allowed under Florida Statutes 255.20 (1) (c)(1) for selection of the contractor and materials; and WHEREAS, Shoreline Foundation Inc., has been awarded the bid for in amount not to exceed $1,129,466.40, to purchase and install 49,538 square feet of the replacement decking; and WHEREAS, this project will be submitted to the Florida Emergency Management Agency to recover the reimbursable project cost; and WHEREAS, as stipulated in Florida Statutes 255.20(1)(c)(1), the provisions of this subsection are not applicable because the project is being undertaken to repair an existing public facility that was damaged due to Hurricane Wilma; and City of Miami Page I of 2 Printed On: 11/10/2005 File Number: 05-01321 WHEREAS, this matter is being considered at an advertised public hearing and by the City Commission as required pursuant to Sections 18-89 and 18-90 of the City Code; and WHEREAS, said findings of the City Manager has been duly considered and adopted by the City Commission; NOW THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing , the City Manager's emergency finding, waiving the requirements for competitive sealed bidding procedures, pursuant to Sections 18-89 and 18-90 of the City Code, is ratified, approved and confirmed, and an award of a contract to Shoreline Foundation Inc., for the purchase and installation of 49,538 square feet of high quality fiberglass decking, which will replace the existing custom Ipe hardwood, of which approximately 55% was damaged or lost as a result of Hurricane Wilma, in an amount not to exceed $1,129,466.40, is authorized, with funds allocated from various Capital Project accounts, subject to budgetary approval. Section 3. This Resolution shall be effective immediately upon its adoption and signature of the Mayor.{1} APPROVED AS TO FORM AND CORRECTNESS: JORGE L. F RNANDEZ CITY A TO NEY Footnotes: {1) If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
