HomeMy WebLinkAboutR-05-0697City of Miami Legislation Resolution: R-05-0697 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 05-01393 Final Action Date: 11/17/2005 A RESOLUTION OF THE MIAMI CITY COMMISSION, BYA FOUR- FIFTHS (4/STHS) AFFIRMATIVE VOTE, AFTER A PUBLIC HEARING, PURSUANT TO SECTION 2-614 OF THE CITY CODE, WAIVING THE CONFLICT OF INTEREST PROVISIONS CONTAINED IN SECTION 2-612 OF THE CODE OF THE CITY OF MIAMI, FLORIDA ("CITY"), AS AMENDED, TO ALLOW FREDERICA P. BURDEN, PRESIDENT OF KIDDIE KOP CHILD CARE, INC. ("FACILITY"), TO ENTER INTO A LOAN AGREEMENT WITH THE CITY OF MIAMI DEPARTMENT OF COMMUNITY DEVELOPMENT, FOR ECONOMIC DEVELOPMENT ACTIVITIES THAT INCLUDES ADDING THREE CLASSROOMS TO THE FACILITY'S EXISTING BUILDING LOCATED AT 231 NORTHWEST 52 STREET, MIAMI, FLORIDA AND CREATES A MINIMUM OF THREE JOBS FOR AREA RESIDENTS. WHEREAS, Frederica P. Burden is employed with the City of Miami ("City") Department of Police and is the President of Kiddie Kop Child Care, Inc. ("Facility"); and WHEREAS, Section 2-612 of the Code of the City of Miami, Florida ("City Code"), as amended, prohibits a City employee from entering into any contract or transacting any business with the City; and WHEREAS, Section 2-614 of the City Code, allows the City Commission to waive such prohibitions if a contract is in the best interest of the City; and WHEREAS, the Facility provides 24 hour child care services in an area where greater than 51 % of the population is low to moderate income households; and WHEREAS, said service is unique in nature and in the best interest of the City and its residents; and WHEREAS, waiving the conflict of interest will allow a minority run business to add three classrooms to their existing building, increasing its capacity by approximately sixty (60) City -area children and provide a minimum of three jobs for City residents; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The prohibitions contained in Section 2-612 and 2-614 of the City Code, are waived by a four -fifths (4/5ths) affirmative vote of the members of the City Commission, after a public hearing, as such prohibitions pertain to Frederica P. Burden, President of the Facility, entering into a loan agreement with the City Department of Community Development, for economic development City of Miami Page 1 of 2 File Id: 05-01393 (Version: 1) Printed On: 12/9/2016 File Number: 05-01393 Enactment Number: R-05-0697 activities that includes adding three classrooms to the Facility's existing building located at 231 Northwest 52 Street, Miami, Florida and creates a minimum of three jobs for area residents. Section 3. The waiver set forth in Section 2 hereof, is based upon the following findings: a) the Facility provides 24 hour child care services in an area where greater than 51 % of the population is low -moderate income households; b) the Facility's 24 hour child care services are unique in nature; c) said services are in the best interest of the City; d) allows a minority run business to increase its capacity by approximately sixty (60) City area children and provide at least three employment opportunities for City residents. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor {1 }. Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
