HomeMy WebLinkAboutR-05-0687City of Miami Legislation Resolution: R-05-0687 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 05-01272 Final Action Date: 11/17/2005 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A JOINT PARTICIPATION AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT"), FOR THE DESIGN AND CONSTRUCTION OF A PORTION OF CAPITAL IMPROVEMENT PROJECT NO. B-30337 "BISCAYNE BOULEVARD RECONSTRUCTION, BETWEEN NORTHEAST 14TH AND NORTHEAST 15TH STREETS," IN CONNECTION WITH THE PERFORMING ARTS CENTER OPENING AND THE COMMUNITY REDEVELOPMENT AGENCY'S STREETSCAPE PROJECT, WITH FDOT COMMITTING TO REIMBURSE THE CITY OF MIAMI THE COST OF DESIGN AND CONSTRUCTION, IN THE LUMP SUM OF $1,650,000, IN FISCAL YEAR 2007-2008; ALLOCATING FUNDS FROM CAPITAL PROJECT NO. 341330, B-30337, FOR SAID PURPOSE, UNTIL THE SCHEDULED FISCAL YEAR 2007-2008 FDOT REIMBURSEMENT. WHEREAS, the Community Redevelopment Agency ("CRA") has asked the Department of Capital Improvements and Transportation ("Department") to assist in implementing right-of-way improvements in all roads surrounding and leading to the new Performing Arts Center ("PAC"), consisting primarily of milling and resurfacing, curb and gutter replacement, sidewalk repairs and installation of sidewalk pavers, signage and decorative lighting ("Improvements"); and WHEREAS, the City of Miami ("City") and interested parties are eager to have the Improvements completed by the soft opening of the PAC in August of 2006; and WHEREAS, to minimize conflict with multiple contractors working in the same areas, the Department has sought the cooperation of Miami -Dade County and the Florida Department of Transportation ("FDOT") for existing construction contracts in the vicinity of the Improvements; and WHEREAS, FDOT has an existing design and construction project on Biscayne Boulevard (State Road 5/U.S.-1) from Northeast 13th Street to Northeast 38th Street, Miami, Florida, programmed under State Financial Project No. 414624-1-52-01, the construction funding of which is allocated in Fiscal Year 2007-2008; and WHEREAS, FDOT has agreed to split out a portion of this larger project closest to the PAC, specifically the one -block section of Biscayne Boulevard from Northeast 14th to Northeast 15th Streets, Miami, Florida, which consists of the design and construction of roadway, new drainage, new lighting, new signs, new sidewalks and new landscaping (hereinafter the "Boulevard Project"); and WHEREAS, in order to expedite completion of the Boulevard Project in advance of FDOT's 2005/06-2009/10 Five -Year Adopted Work Program, and FDOT will allow the Department to administer project design and construction utilizing City resources in the current Fiscal Year 2005- 2006; and City of Miami Page 1 of 2 File Id: 05-01272 (Version: 2) Printed On: 12/9/2016 File Number: 05-01272 Enactment Number: R-05-0687 WHEREAS, FDOT will reimburse the City for eligible incurred project expenses in future Fiscal Year 2007-2008; and WHEREAS, the attached Joint Participation Agreement ("JPA") was negotiated with FDOT, and details the responsibilities of the City for the Boulevard Project; and WHEREAS, the funds for this purpose are available from Capital Project No. 341330, B-30337 until the FDOT reimbursement is available; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to execute a JPA, in substantially the attached form, with the FDOT, for the design and construction of a portion of Capital Improvement Project No. B-30337, entitled "Biscayne Boulevard Reconstruction, between Northeast 14th and Northeast 15th Streets," in connection with the PAC opening and the CRA's Streetscape project, with FDOT committing to reimburse the cost of design and construction in the lump sum of $1,650,000, in fiscal year 2007-2008, with funds allocated from Capital Project No. 341330, B-30337, for said purpose, until the scheduled Fiscal Year 2007-2008 FDOT reimbursement. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
