HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fl.us File Number: 05-01267 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AMENDING THE CITIZEN PARTICIPATION PLAN ("PLAN"), PREVIOUSLY APPROVED BY RESOLUTION NO. 04-0114, ADOPTED FEBRUARY 26, 2004, AND SUBSTITUTING IT WITH THE PLAN, ATTACHED AND INCORPORATED; UPDATING THE PLAN TO COMPLY WITH THE CODE OF FEDERAL REGULATION 24 CFR 91.105, WHICH MANDATES THAT A THIRTY (30) DAY COMMENT PERIOD IS REQUIRED PRIOR TO A SCHEDULED PUBLIC HEARING WHEN CHANGES IN FUNDING ALLOCATIONS ARE MADE AND/OR WHEN THE FOLLOWING UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT ("U.S. HUD") REQUIRED DOCUMENTS ARE ORIGINALLY DRAFTED (PRIOR TO SUBMISSION TO U.S. HUD) AND/OR ARE AMENDED: THE CONSOLIDATION PLAN, ANNUAL ACTION PLAN, CITIZEN PARTICIPATION PLAN AND THE FAIR HOUSING PLAN; AND INCLUDING A RELOCATION STRATEGY COMPONENT. WHEREAS, federal regulations require entitlement municipalities to adopt a Citizen Participation Plan ("Plan") relating to grants received from the United States Department of Housing and Urban Development ("U.S. HUD"); and WHEREAS, pursuant to Resolution Number 04-0114, adopted February 26, 2004, the City Commission approved the new Plan; and WHEREAS, in order to comply with federal regulation 24 CFR 91.105, the Administration has determined that further clarification of the 30 day comment period is necessary; and WHEREAS, the 30 day comment period gives City of Miami residents the opportunity to comment, in writing, on any changes in funding allocations, and/or when the following U.S. HUD required documents are originally drafted (prior to submission to U.S. HUD) and /or are amended: the Consolidation Plan, Annual Action Plan, Citizen Participation Plan and the Fair Housing Plan; and WHEREAS, the advertisement of the comment period will be included in public hearing advertisements thirty (30) calendar days prior to a scheduled public hearing, before approval of the item by the City Commission; and WHEREAS, included in the amended Plan is a relocation strategy component; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAM1, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Plan, previously approved by Resolution No. 04-0114, adopted February 26, 2004, City of Miami Page 1 of 2 Printed On: 11/2/2005 File Number: 05-01267 is amended and substituted with the new Plan, attached and incorporated, by updating the Plan to comply with the Code of Federal Regulation 24 CFR 91.105, which mandates that a thirty (30) day comment period is required prior to a scheduled public hearing when changes in funding allocations are made and/or when the following U.S. HUD documents are originally drafted (prior to submission to U.S. HUD) and/or are amended: the Consolidation Plan, Annual Action Plan, Citizen Participation Plan and the Fair Housing Plan, and including a relocation strategy component. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} APPROVED AS TO FORM AND CORRECTNESS: JORG: L.
