HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.cl.miami.fl.us File Number: 05-01244 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING AN INCREASE IN THE PROFESSIONAL SERVICES AGREEMENT ("AGREEMENT') WITH MERCY MEDICAL DEVELOPMENT D/B/A MERCY OUTPATIENT CENTER, FOR THE PROVISION OF SWORN POLICE ANNUAL PHYSICAL EXAMINATION SERVICES, FOR THE DEPARTMENT OF EMPLOYEE RELATIONS, PURSUANT TO RESOLUTION NO. 04-0617, ADOPTED SEPTEMBER 23, 2004, IN AN ANNUAL AMOUNT NOT TO EXCEED $98,268, INCREASING THE TOTAL ANNUAL AMOUNT FROM $415,240 TO $513,508; ALLOCATING FUNDS IN THE AMOUNT NOT TO EXCEED $98,268, FROM THE GENERAL OPERATING BUDGET OF THE DEPARTMENT OF POLICE, ACCOUNT CODE NO. 001000.290201.6.260; AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT NO. 1 TO THE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PURPOSE; AMENDING RESOLUTION NO. 04-0617, TO REFLECT SAID INCREASE. WHEREAS, pursuant to Resolution No. 04-0617, adopted September 23, 2004, the City of Miami ("City") entered into a Professional Services Agreement ("Agreement") with Mercy Medical Development d/b/a Mercy Outpatient Center, for the provision of sworn police annual physical examination services ("Services"), in an annual amount not to exceed $415,240; and WHEREAS, Mercy Medical Development d/b/a Mercy Outpatient Center has provided the required Services; and WHEREAS, a larger quantity of additional/optional testing has been conducted on an as -needed basis, using funds more rapidly than anticipated; and WHEREAS, the City Manager and the Director of Employee Relations recommend increasing the annual amount of compensation under the Agreement, in an annual amount not to exceed $98,268, from $415,240 to $513,508, to cover the cost of the additional/optional testing; and WHEREAS, funds for said increase are available from the General Operating Budget of the Department of Police, Account Code No. 001000.290201.6.260; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. An increase in the Agreement with Mercy Medical Development d/b/a Mercy Outpatient Center, for the provision of Services, for the Department of Employee Relations, pursuant to Resolution No. 04-0617, adopted September 23, 2004, in an annual amount not to exceed $98,268, City of Miami Page 1 of 2 Printed On: 11/8/2005 File Number. 05-01244 increasing the total annual amount from $415,240 to $513,508, is authorized. Section 3. Resolution No. 04-0617, adopted September 23, 2004, is amended in the following particulars;{1 } "Resolution No. 04-0617 Section 3. The City Manager is authorized{1} to negotiate and execute an Agreement with Mercy for a two-year period with the option to renew for two additional two-year periods, at an estimated annual amount not to exceed $115,210 $513,508,, with increases not to exceed five percent (5%) for each renewable period for an estimated total contract amount of $2,757,536 $ , with funds allocated from the General Operating Budget of the Department of Police, Account Code No. 001000.290201.6.260. * * * *11 Section 4. Funds in the amount of $98,268, are allocated from the General Operating Budget of the Department of Police, Account Code No. 001000.290201.6.260. Section 5. The City Manager is authorized{2} to execute Amendment No. 1 to the Agreement, in substantially the attached form, for said purpose. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{3} APPROVED AS TO FORM AND CORRECTNESS: JORGE L.
