HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fl.us File Number: 05-01258 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT A REIMBURSEMENT GRANT IN THE AMOUNT OF $1,000,000, AND TO EXECUTE THE FLORIDA INLAND NAVIGATION DISTRICT ("FIND") PROJECT AGREEMENT, PROJECT NO. DA-MI-05-88, IN SUBSTANTIALLY THE ATTACHED FORM, FOR THE CAPITAL PROJECT NO. B-30310, ENTITLED "BICENTENNIAL PARK SHORELINE STABILIZATION - PHASE III;" APPROPRIATING FUNDS FOR ITS OPERATION, ALLOCATING FUNDS IN THE AMOUNT OF $1,000,000, FROM CAPITAL IMPROVEMENT PROJECT FUND NO. 331418, ENTITLED "BICENTENNIAL PARK IMPROVEMENTS," FOR THE REQUIRED MATCH, AND AUTHORIZING THE CITY MANAGER TO PROVIDE ALL NECESSARY DOCUMENTS IN ORDER TO IMPLEMENT ACCEPTANCE OF AND COMPLIANCE WITH SAID GRANT. WHEREAS, pursuant to Resolution No. 05-0120, adopted February 24, 2005, as amended by Resolution No. 05-0324, adopted May 26, 2005, the City Manager was authorized to submit an application for grant funding to the Florida Inland Navigation District ("FIND") under its Waterways Assistance Program for the Bicentennial Park Shoreline Stabilization Project, Phase III, Job No. B- 30310; and WHEREAS, this is the final phase of the project and will complete the restoration of the seawall along the former FEC slip, and provides both shoreline stabilization and a tie-in to a future public plaza and the continuation of a pedestrian promenade; and WHEREAS, FIND had previously awarded funds for Phases I and 11 of the project, in the amounts of $700,000 and $419,670, respectively; and WHEREAS, the attached reimbursement grant agreement provides FIND funds of $1,000,000 and details the responsibilities of the City for the implementation of the project and maintenance of the completed improvement; and WHEREAS, funds for the appropriation for operation and the required 50% match of the total amount of the project are available from Capital Improvement Project ("CIP") Fund No. 331418 and the grant award from FIND will be accepted into that same CIP Fund No. 331418; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized {1} to accept a reimbursement grant in the amount of $1,000,000, from the FIND, to appropriate the funds for its operation, to execute the FIND Project City of Miami Page 1 of 2 Printed On: 11/8/2005 File Number: 05-01258 Agreement, Project No. DA-MI-05-88, in substantially the attached form, for Capital Project Job No. B- 30310, entitled "Bicentennial Shoreline Stabilization - Phase III," with funds in the amount of $1,000,000 allocated from CIP Fund No. 331418, entitled "Bicentennial Park Improvements," for the required match, and to provide all necessary documents in order to implement acceptance of and compliance with said grant. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {2} APPROVED AS TO FORM AND CORRECTNESS: JORGE L. FERNANDEZ CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
