A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE PURCHASE OF TWO (2) 2006, 25' CONTENDER VESSELS
WITH TWIN YAMAHA ENGINES, TRAILERS AND OTHER ACCESSORIES, AS
LISTED IN "EXHIBIT A," ATTACHED AND INCORPORATED, AS AUTHORIZED
UNDER THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF
MIAMI AND THE STATE OF FLORIDA COUNTER -DRUG PROCUREMENT
PROGRAM, ESTABLISHED AND MAINTAINED PURSUANT TO THE NATIONAL
DEFENSE AUTHORIZATION ACT SECTION 1122, KNOWN AS THE "1122
PROGRAM," FROM CONTENDER BOATS, INC., FOR THE DEPARTMENT OF
POLICE, IN AN AMOUNT NOT TO EXCEED $179,311.02; ALLOCATING FUNDS
FROM THE URBAN AREAS SECURITY INITIATIVE GRANT PROGRAM III,
FISCAL YEAR 2004, ACCOUNT CODE NO. 110143.280911.6.840, IN THE
AMOUNT OF $89,655.51 AND FROM THE POLICE GENERAL FUND, ACCOUNT
CODE NO. 001000.290301.6.830, IN THE AMOUNT OF $89,655.51.
WHEREAS, the procurement of two (2) 2006, 25' Contender Vessels will be utilized by the City of
Miami ("City")Department of Police's Marine Patrol Unit to patrol the Miami River and other City
waterways and waterfronts to enhance the City Department of Police's Homeland Security Initiative;
and
WHEREAS, the vessels will also be used with both the Organized Crime and Terrorism Section, in
joint operations with various federal local agencies to interdict drug traffickers; and
WHEREAS, the interdiction of drug traffickers clearly follows the edict of the National Defense
Authorization Act Section 1122, known as the "1122 Program" ("1122 Program") which requires that
law enforcement agencies provide documentation that equipment purchases be used in the support of
counter -drug activities; and
WHEREAS, the vessels, with twin Yamaha engines, trailers and other accessories are being
purchased as authorized under the Memorandum of Understanding between the City and the State of
Florida Counter -Drug Procurement Program, established and maintained pursuant to the 1122
Program;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The purchase of two (2) 2006, 25' Contender Vessels with twin Yamaha engines, trailer
and other accessories, as listed in "Exhibit A," attached and incorporated, as authorized under the
Memorandum of Understanding between the City and the State of Florida Counter -Drug Procurement

Program, established and maintained pursuant to the 1122 Program, from Contender Boats, Inc., for
the Department of Police, in an amount not to exceed $179,311.02, is authorized, with funds allocated
from the Urban Areas Security Initiative Grant Program III, Fiscal Year 2004, Account Code No.
110143.280911.6.840, in the amount of $89,655.51 and from the Police General Fund, Account Code
No. 001000.290301.6.830, in the amount of $89,655.51.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}

Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
