Page 1 of 2 SUPPLEMENT TO AGENDA ITEM SUMMARY FORM Background Information: By Ordinance No. 11662, adopted on May 26, 1998 FPL Energy Services, Inc. was granted a Franchise Agreement with the City to install, operate and maintain a chilled water system in the public rights -of -way to provide service to their customers. On September 1, 2001, FPL Energy Services, Inc. assigned its interest in the Franchise Agreement to a wholly -owned subsidiary, FPL Thermal Systems, Inc., without the filing of a written notice with the City Clerk in advance of such agreement as required by their Franchise Agreement with the City. FPL Energy Services, Inc. subsequently sold and transferred all outstanding shares of FPL Thermal Systems, Inc. to TECO BGA, Inc. TECO Thermal Systems, Inc., previously known as FPL Energy Services, Inc. has been satisfactorily performing the obligations required by the Franchise Agreement since their assumption of the Franchise Agreement. The administration has reviewed the Franchise Agreement and recommends that it is in the best interest of the City, and to the benefit of its residents, to continue the services now provided by TECO Thermal Systems, Inc. under the terms and conditions of the Franchise Agreement. The attached Ordinance will rectify by waiver the notice requirement omission and approve, for the avoidance of any doubt, the transfer of the privileges of the Franchise Agreement to TECO Thermal Systems, Inc.
