HomeMy WebLinkAboutR-05-0650City of Miami Legislation Resolution: R-05-0650 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 05-01289 Final Action Date: 11/3/2005 A RESOLUTION OF THE MIAMI CITY COMMISSION EXTENDING THE DECLARATION OF AN EXEMPTION FROM THE PROHIBITIONS AND RESTRICTIONS CONTAINED IN SECTIONS 36-4(A) AND 36-5 (A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AS RELATED TO THE LEVEL AND HOURS OF NOISE RESULTING FROM SAVE DADE'S 10TH ANNUAL HALLOWEEN FUNDRAISER FROM OCTOBER 29, 2005, TO NOVEMBER 19, 2005, AT LEGION PARK, WITH THE LOCATION AND TIME PERMITTED BY THE OFFICE OF FILM ARTS, CULTURE AND ENTERTAINMENT. WHEREAS, a declaration of an exemption from the "Noise Ordinance" as related to the Save Dade's 10th Annual Halloween Fundraiser was granted on October 29, 2005; and WHEREAS, an extension of the declaration had not been requested previously due to postponements of City Commission meetings and inclement weather conditions; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The exemption declared from the prohibitions and restrictions contained in Sections 36-4(a) and 36-5 (a) of the Code of the City of Miami, Florida, as amended, as related to the level and hours of noise resulting from Save Dade's 10th Annual Halloween Fundraiser, is extended from October 29, 2005 to November 19, 2005, at Legion Park, with the location and time permitted by the Office of Film Arts, Culture and Entertainment. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
