A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT, IN
SUBSTANTIALLY THE ATTACHED FORM, TO THE AGREEMENT WITH
RECREATIONAL DESIGN AND CONSTRUCTION, INC. ("RDC") DATED JUNE 13,
2005, FOR THE PROJECT ENTITLED "GRAPELAND HEIGHTS PARK BALLFIELD
COMPLEX, B-60496," TO INCLUDE ENVIRONMENTAL SITE REMEDIATION WORK
AND TO INCREASE THE AMOUNT OF COMPENSATION, TO PAY FOR SUCH
WORK, BY AN AMOUNT NOT TO EXCEED $4,800,000, FROM $5,979,063 TO
$10,779,063; ALLOCATING FUNDS FROM B-60496 CAPITAL IMPROVEMENT
PROJECT NOS. 311711, 331419, AND 333138, FOR SAID PURPOSE.
WHEREAS, pursuant to Resolution No. 05-0137, adopted March 1, 2005, the City Commission
authorized the City Manager to enter into a design/build agreement with Recreational Design and
Construction, Inc. ("RDC"), for the project entitled Grapeland Heights Park Ballfield Complex,"
B-60496 ("Project"), in an amount not to exceed $7,000,000; and
WHEREAS, the City of Miami ("City") and RDC entered into a Design Build Agreement, on June
13, 2005, in the amount of $5,979,063 ("Contract"); and
WHEREAS, subsequent to execution of the Contract, geotechnical testing performed on the
property identified soil contamination; and
WHEREAS, the Project cannot proceed further without remediation of the site as approved by the
Miami -Dade County Department of Environmental Research and Management ("Remediation Work");
and
WHEREAS, Capital Improvements and Transportation ("CIT") assisted RDC in the solicitation and
evaluation of bids from subcontractors, to perform the Remediation Work under the Contract, and CIT
and RDC have negotiated a change order to the Contract for the performance of the Remediation
Work;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized {1} to execute an Amendment, in substantially the
attached form, to the Contract with RDC, for the Project, to include the provision of environmental site
remediation work and to increase the amount of compensation, to pay for such work, by an amount
not to exceed $4,800,000, with funds allocated from B-60496, Capital Improvement Project Nos.
311711, 331419, and 333138, for said purpose.

Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City
Charter and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
