HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.ci.miami.fl.us File Number: 05-01123 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE TRANSFER OF FUNDS, IN THE AMOUNT NOT TO EXCEED $1,500,297, FROM SPECIAL REVENUE ACCOUNT NO. 110145, "THE FEC CORRIDOR IMPROVEMENT TRUST FUND;" ALLOCATING SAID FUNDS TO CAPITAL IMPROVEMENTS PROJECT NO. 341330,"B-71215D STREETCAR PROJECT -MIDTOWN UNDERGROUND INFRASTRUCTURE," TO PROVIDE THE CONSTRUCTION OF UNDERGROUND INFRASTRUCTURE AND RELATED ENGINEERING SERVICES TO ACCOMMODATE THE MIAMI STREETCAR PROJECT WITHIN THE MIDTOWN MIAMI PROJECT. WHEREAS, pursuant to Ordinance No. 12468, adopted December 18, 2003, the City Commission approved the "FEC Corridor Improvement Trust Fund" entitled "Planning and Zoning," entitled "Tree Trust Fund;" and WHEREAS, Section 62-263 of the FEC Corridor Improvement Trust Fund ("Trust Fund") was established "to facilitate the creation and implementation of programs to improve and develop integrated public transportation system, current economic levels, housing opportunities and streetscapes, through means which may include, but are not Limited to..." (1) "...premium and connected transit system throughout the FEC Corridor, such as electric/fuel cell trolley connecting the northern end of the FEC Corridor to the downtown Miami area, ..." (2) "...streetscape and public infrastructure improvement...," (3) ..."related activities as may be appropriate to carry out the intent of this article...;" and WHEREAS, the Department of Capital Improvement Projects ("CIP") and Transportation is requesting an amount not to exceed $1,500,297 from the Trust Fund to be made available to the Miami Streetcar Project ("Project"), a project that qualifies in accordance with said Section 62-263 and that is to provide service within the FEC Corridor; and WHEREAS, Section 62-265 of the Trust Fund indicates that "...all disbursals of Trust Fund monies shall be made by the City Commission, after due consideration is given to the written recommendations of the City Manager and the directors of the departments of Planning (formerly Planning and Zoning), Economic Development, Public Works, and CIP and Transportation (formerly the Department of CIP and formerly the Office of Transportation);" and WHEREAS, the attached memorandum dated September 26, 2005, from the Director of the Department of CIP and Transportation to the City Manager contains the signatures of said department directors and the City Manager affirming their review and approval for the use of the Trust Fund amount of $1,500,297 for the purpose of the Project within the Midtown Miami Project; and WHEREAS, the requested amount will be allocated to CIP Project No. 341330, "B-71215D Streetcar Project -Midtown Underground Infrastructure" as defined in "Exhibit A," attached and incorporated, to said memorandum, entitled "Roadway and Surface Construction Elements and City of Mlainl Page 1 of 2 Printed On: 10/18/2005 File Number: 05-01123 Related Engineering Services for the Project within the Midtown Miami Project;" NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The transfer of funds, in the amount not to exceed $1,500,297, from Special Revenue Account No. 110145, "FEC Corridor Improvement Trust Fund," and the allocation of said funds to CIP Account No. 341330, "B-71215D Streetcar Project -Midtown Underground Infrastructure," to provide the construction of underground infrastructure and related engineering services to accommodate the Project within the Midtown Miami Project, is authorized. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. {1} APPROVED AS TO LEGAL FORM AND CORRECTNESS:''/ CITY ATTORNEY Footnotes {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
