A RESOLUTION OF THE MIAMI CITY COMMISSION, BYA FOUR -FIFTHS (4/5)
AFFIRMATIVE VOTE, RATIFYING, APPROVING, AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS
FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING AN
INCREASE IN THE CONTRACT WITH MEF CONSTRUCTION, INC., PURSUANT
TO RESOLUTION NO. 03-926, ADOPTED SEPTEMBER 11, 2003, FURTHER
AMENDED PURSUANT TO RESOLUTION NO. 04-0789, ADOPTED DECEMBER 9,
2004, IN AN AMOUNT NOT TO EXCEED $317,681.88, INCREASING THE
CONTRACT FROM $1,715,658 TO $2,033,339.88, FOR ADDITIONAL WORK
REQUIRED FOR THE PROJECT ENTITLED "ROADWAY REHABILITATION,
B-40656 (FORMERLY B-4656)," COMMONLY KNOWN AS THE NORTHWEST 19TH
TERRACE PROJECT; ALLOCATING FUNDS FOR SAID INCREASE FROM
CAPITAL IMPROVEMENT PROJECT NO. B-30228, ENTITLED "NORTHWEST 19TH
TERRACE SWALE RESTORATION;" AUTHORIZING THE CITY MANAGER TO
EXECUTE AN AMENDMENT TO THE CONTRACT, IN SUBSTANTIALLY THE
ATTACHED FORM, FOR SAID PURPOSE.
WHEREAS, MEF Construction, Inc., entered into a contract dated November 3, 2003, to perform
the reconstruction of road pavement and construction of drainage improvements as described in
plans and specifications for the project entitled "Roadway Rehabilitation, B-40656 (formerly B-4656),"
commonly known as the Northwest 19th Terrace Project, pursuant to Bid No. 02-03-207 and
approved by Resolution No. 03-926, adopted September 11, 2003; and
WHEREAS, the contract was subsequently amended to provide for additional unforeseen work
pursuant to Resolution No. 04-0789, adopted December 9, 2004; and
WHEREAS, in the course of reconstructing the roadway pavement and drainage improvements,
the City of Miami and MEF Construction, Inc., identified additional work required immediately to
properly complete the job and restore disrupted streets in the neighborhood and this work involved
concrete sidewalk restoration, drainage structure adjustments, swale reconstruction and driveway
reconstruction; and
WHEREAS, the City Manager has made a finding of an emergency approving an increase in the
contract by $317,681.88, from $1,715,658 to $2,033,339.88, for the additional work; and
WHEREAS, funds to cover the increase are available from Capital Improvement Project ("CIP")
No. B-30228 entitled "Northwest 19th Terrace Swale Restoration;"
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by

reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5) affirmative vote, the City Manager's finding of an emergency,
waiving the requirements for competitive sealed bidding procedures and approving an increase in the
contract with MEF Construction, Inc., pursuant to Resolution No. 03-926, adopted September 11,
2003, further amended pursuant to Resolution No. 04-0789, adopted December 9, 2004, in an
amount not to exceed $317,681.88, increasing the contract from $1,715,658 to $2,033,339.88, for
additional work required for the project entitled "Roadway Rehabilitation, B-40656 (formerly B-4656),"
commonly known as the Northwest 19th Terrace Project, is ratified, approved and confirmed, with
funds for said increase, allocated from CIP No. B-30228, entitled "Northwest 19th Terrace Swale
Restoration."
Section 3. This increase is necessitated by repair or maintenance of an existing public facility,
namely the drainage facility structures, located within the project boundaries, and this work is
therefore exempted from the requirements of Chapter 255.20, Florida Statutes, by subsection (1) (c)
(5).
Section 4. The City Manager is authorized{1} to execute an Amendment to the contract, in
substantially the attached form, for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
