BACKGROUND
The Department of Capital Improvements and Transportation is responsible to oversee the
reconstruction of streets and the construction of drainage improvements under the project
entitled "Road Rehabilitation Project B-40656 (formerly B-4656)," commonly known as the NW
19th Terrace Project. The project sites included SW 27th Street 600 feet from SW 37th Avenue,
and the area bounded by NW 18th Terrace, NW 20th Street, NW 31st Avenue and NW 37th
Avenue.
The City awarded a contract to MEF Construction, Inc. in September 2003 pursuant to
Resolution No. 03-926 in the total amount of $1,595,658, based on plans and specifications
issued under Bid. No. 02-03-207. The contract was duly executed by the parties November 3,
2003. In December 2004 by Resolution 04-01314, the City Comission approved an increase in
the contract of $120,000 to cover unforeseen work.
During the continuation of the construction and underground work, more deteriorated conditions
were revealed that required immediate attention. This additional work included sidewalk
restoration, drainage adjustments, and the reconstruction of swales and affected driveways.
Such additional work had to be performed immediately to properly complete the job and restore
disrupted streets in the neighborhood so as to allow safe passage of residents to their homes.
The amount of the additional work, $317,681.88, brings the total contract amount to
$2,033,339.88.
FINDING
The Department of Capital Improvements and Transportation finds and determines that it was in
the best interest of the City to waive competitive bids and secure the services of the existing on -
site construction contractor, MEF Construction, Inc. to immediately conduct the needed right -of
way repairs, The Contractor was completely knowledgeable of the existing site and conditions,
was already present and mobilized on site, and was qualified, licensed and willing to perform
the additional work.
As provided in accordance with Section 18-89 (Public Works and Contracts) of the Code of the
City of Miami and as allowed under Florida Statutes §255.20, we recommend that the City
Manager affirm and adopt these findings and forward the matter to the City Commission for its
approval.
