B-40656SFormerly B-4656) This Amendment to the Contract dated November 3, 2003 (the "Contract") between the City of Miami, a municipal corporation of the State of Florida ("CITY"), and MEF Construction, Inc. ("CONTRACTOR") for the Project entitled "ROAD REHABILITATION PROJECT", Project No. B-40656 (formerly B-4656), ("PROJECT") is entered into this day of , 2005. RECITALS WHEREAS, the Contract was entered into pursuant to the approval of the City Commission by Resolution No. 03- dated September 11. 2003 in the total amount of $1,595,658 for the Scope of Work included in the original Contract Documents for the PROJECT; and WHEREAS, the Purchase Order was subsequently increased pursuant to City Commission approval granted by Resolution No. 04-01314 of December 9, 2004 to provide for additional work and an increase of $120,000, for a revised total amount of $1,715,658; and WHEREAS, it has been determined that it is in the City's best interest to make modifications to the PROJECT's Scope of Work to allow the proper completion of the Project by including additional concrete sidewalk restorations, drainage structure adjustments, reconstruction of swales and affected driveways; and WHEREAS, the City Commission has adopted Resolution No. on 2005 to approve such modifications to the Scope of Work, the corresponding increase in the Contract Sum, and to provide additional terms and conditions that are deemed to be in the City's best interest; NOW THEREFORE, for the considerations hereinafter set forth: The Agreement dated November 3, 2003 and amended on , 2004 is hereby further amended as follows: 1. Existing provisions of the Contract are amended in the following particulars: a. Article 1. Scope of Work shall be revised to include all labor, materials and equipment required to perform the additional work in the manner and form described in Exhibit A to this Amendment 2, attached and incorporated by reference as if set forth in full, and consistent with all applicable terms and conditions of the Contract Documents. b. Article 2. CONTRACT SUM shall be increased by $120,000 and by $317,681.88 to the new sum of Two Million, Thirty -Three Thousand, Three Hundred Thirty -Nine Forty Dollars and Eighty -Eight Cents ($2,033,339.88). c. Article 4. Time of Completion shall be extended by . working days. 2. The following new provisions shall be added: a. Option to Increase and Extend Contract: The City shall have the option to increase the Contract Sum and for the Time of Performance, subject to the approval of the City Commission, to allow for additionai work that is directly related to the Work approved and identified herein. b. Pricing for Contract Increases: Pricing for such increases shall be identical to the unit prices listed for original Contract items included in the Contract, except that modifications may be negotiated for the cost of materials where Contractor presents verifiable documentation that support and justify industry or marketplace fluctuations. All other terms and conditions of the contract are in effect and remain unchanged.
