HomeMy WebLinkAboutR-05-0612City of Miami Legislation Resolution: R-05-0612 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 05-01107 Final Action Date: 11/3/2005 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER APPROVING THE FINDINGS OF THE EVALUATION COMMITTEE, PURSUANT TO REQUEST FOR PROPOSALS NO. 04-05-055, THAT THE TOP -RANKED FIRMS TO PROVIDE DELINQUENT DEBT COLLECTION SERVICES ARE, IN RANK ORDER: (1) PENN CREDIT CORPORATION; (2) FINANCIAL ASSET MANAGEMENT SYSTEMS; AND (3) MERCANTILE ADJUSTMENT BUREAU; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A PROFESSIONAL SERVICES AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, WITH PENN CREDIT CORPORATION, THE TOP -RANKED FIRM, FORATWO (2) YEAR PERIOD, WITH THE OPTION TO EXTEND FOR TWO (2) ADDITIONAL TWO (2) YEAR PERIODS; ALLOCATING FUNDS FOR SAID SERVICE FROM ACCOUNT NO. 001000.260301.6.270; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AN AGREEMENT WITH THE SECOND -RANKED FIRM, SHOULD NEGOTIATIONS FAIL WITH THE TOP -RANKED FIRM, OR UNTILA CONTRACT HAS BEEN SUCCESSFULLY NEGOTIATED; DIRECTING THAT THE NEGOTIATED AGREEMENT BE PRESENTED TO THE CITY COMMISSION FOR CONSIDERATION. WHEREAS, pursuant to Section 18-86 of the Code of the City of Miami, Florida, as amended, Request for Proposals ("RFP") No. 04-05-055 was issued to secure delinquent debt collection services for the City of Miami ("City"); and WHEREAS, eight (8) proposals were received and evaluated by an Evaluation Committee appointed by the City Manager, and it recommended that the City Manager be authorized to negotiate and execute the attached Professional Services Agreement ("Agreement") with the top -ranked firm, Penn Credit Corporation; and WHEREAS, should negotiations fail with the top -ranked firm, to negotiate and execute a contract with Financial Asset Management Systems and Mercantile Adjustment Bureau, respectively, for a two (2) year period, with the option to extend for two(2) additional two (2) year periods; and WHEREAS, funding for the delinquent debt collection services is to be allocated from Account No. 001000.260301.6.270. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The recommendation of the City Manager approving the findings of the Evaluation Committee, pursuant to RFP No. 04-05-055, that the top -ranked firms to provide delinquent debt collection services are, in rank order: (1) Penn Credit Corporation; (2) Financial Asset Management Systems; and (3) Mercantile Adjustment Bureau, is accepted. Section 3. The City Manager is authorized{1} to negotiate and execute an Agreement, in substantially the attached form, with Penn Credit Corporation, the top -ranked firm, for a two (2) year period, with the option to extend for two (2) additional two (2) year periods, with funds for said service allocated from Account No. 001000.260301.6.270. Section 4. The City Manager is further authorized{1} to negotiate an Agreement with the second -ranked firm, should negotiations fail with the top -ranked firm, or until a contract has been successfully negotiated. Section 5. The City Manager is directed to present the negotiated Agreement to the City Commission for consideration. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} This Resolution shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
