Subject: A resolution vacating, discontiniuing and abandoning the South ten (10) feet of the East ten
(10) feet of the North half (1/2) of Lot 10, Block 2, A RESUBDIVISION OF BLOCK NO, 2,
RIVERSIDE FARMS, according to the Plat thereof, as recorded in Plat Book 18, Page 27, and
authorizing and directing the City Manager to execute a quit claim deed for the return of the same to the
present adjacent property owner.
Purpose of Item:
The purpose is for the City Commission to adopt a resolution vacating, discontinuing and abandoning
the South ten (10) feet of the East ten (10) feet of the North half (1/2) of Lot 10, Block 2,
RESUBDIVISION OF BLOCK NO. 2, RIVERSIDE FARMS, Plat Book 18, Page 27, and
authorizing and directing the City Manger to execute a quit claim to return the same to the present
adjacent property owner.
Background Information:
In 1986, the East ten (10) feet of the North half (1/2) of Lot 10, Block 2, A RESUBDIVISION OF
BLOCK NO. 2, RIVERSIDE FARMS, Plat Book 18, Page 27, were dedicated to the City of Miami
in that deed of dedication recorded in Official Records Book 12797, Page 380. Recently, the adjacent
property owner requested a return of the South ten (10) feet of the said East ten (10) feet of the North
half (1/2) of Lot 10, because the 1986 dedication causes the owner's existing building to
encroachment into this area of the right-of-way of N.W. 23 Court. The Department of Public Works
has reviewed the adjacent owner's property survey and the 1986 deed of dedication and confirms the
said encroachment and recommends the return of the South ten (10) feet of said East ten (10) feet of
the North half (1/2) of Lot 10 to the present adjacent property owner.
