HomeMy WebLinkAboutVariance Analysis (2)ANALYSIS FOR VARIANCE 2957, 2981 & 2951 SW 38th Court and 3841, 3845 3851 Bird Road Case No. 2005-0978 Pursuant to Section 401 of Ordinance 11000, as amended, The Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed for Variance as follows: Maximum of stories allow: Required - 10 Proposed - 13 The following findings have been made: • It is found that a literal interpretation of the provisions of the Zoning Ordinance would deprive the applicant of the rights commonly enjoyed by other properties within the same zoning district. • It is found that in order to develop the site as permitted there is not enough space to provide the required number of stories. However, the maximum height of one hundred and twenty feet (120) allowed by the Zoning Ordinance is not been exceeded as part of this proposal. • It is found that requested number of stories would not have an adverse effect on the adjacent areas especially since they are being accommodated within the allowed one hundred twenty (120) feet height limit. The proposed project offers the most reasonable solution to the design of exceeding the overall number of proposed stories. Based on these findings, the Planning Department is recommending approval of the requested number of stories variance as presented. Literal interpretation of ordinance causes undue hardship on petitioner. Granting variance conveys same treatment to owner. Variance, if granted, is the minimum variance for reasonable use of property. Is in harmony with general intent and purpose of ordinance.
